Privacy Policy
Effective Date: 10/14/2026
Last Updated: 10/14/2026
Ignis Rose Care LLC “Ignis Rose Care,” “IRC,” “we,” “us,” or “our”) respects the privacy of individuals whose personal information we collect and is committed to handling personal information responsibly and in accordance with applicable federal and Washington law.
This Website Privacy Policy (the “Privacy Policy”) describes how Ignis Rose Care collects, uses, discloses, stores, retains and protects personal information obtained through or in connection with www.ignisrosecarellc.com and the webpages, forms, content and functionality made available through that website (collectively, the “Website”). This Privacy Policy applies principally to information collected through general enquiries, requests for assessments, referrals, employment enquiries, communications preferences and other interactions with the Website. It also explains how certain health-related information submitted through or in connection with the Website may be handled.
The Website is intended to facilitate preliminary enquiries and administrative communications. It is not intended to serve as the primary means through which Ignis Rose Care collects complete medical records, detailed medical histories or other extensive clinical information. This Privacy Policy should be read together with our Website Terms and Conditions and any additional notice, consent, authorization or privacy documentation provided in connection with a particular service, assessment, referral, employment process or other interaction with Ignis Rose Care. Where applicable law requires a separate privacy notice, consent or authorization, this Privacy Policy is not intended to replace that document.
1. About Ignis Rose Care
Ignis Rose Care is a Washington-based home-care provider offering in-home assistance and support services to individuals who may require assistance with activities of daily living, personal care, household activities, mobility, companionship and other appropriate home-care needs. The Website provides information concerning Ignis Rose Care and its services and enables prospective clients, family members, responsible parties, authorized representatives, healthcare professionals, referral sources and other individuals or organizations to contact Ignis Rose Care, request an initial assessment, submit a referral or otherwise enquire about potential services. The Website may also enable prospective employees or caregivers to express interest in employment opportunities and may provide educational or informational materials relating to home care and related matters. Information collected after an individual progresses beyond a preliminary Website enquiry and enters Ignis Rose Care’s formal assessment, intake, care or employment processes may be governed by additional legal requirements and separate privacy documentation.
2. Scope of the Privacy Policy
This Privacy Policy applies to personal information collected by or on behalf of Ignis Rose Care through, or in connection with, the Website and related online or administrative interactions. In particular, this Privacy Policy applies to personal information collected in connection with general enquiries and contact requests, requests for free or initial assessments, prospective-client enquiries, referrals, and communications with family members, responsible parties, authorized representatives and other persons involved in arranging or coordinating care. It also applies to information collected through communications with healthcare professionals, healthcare providers and other referral sources, as well as employment and “Join Our Team” enquiries, email and text communication preferences, testimonials, reviews and other feedback. In addition, this Privacy Policy applies to personal information processed in connection with the administration, hosting, operation, maintenance and security of the Website and any other Website-based or related administrative functions made available by Ignis Rose Care from time to time.
This Privacy Policy is intended principally to explain how Ignis Rose Care handles personal information collected at the Website and preliminary engagement stage. It does not necessarily govern all information that may subsequently be created, obtained, maintained or used after an individual enters into a formal relationship with Ignis Rose Care.
Where information collected through the Website subsequently becomes part of a client record, care record, health-information record, employment record or other regulated record, that information may also be subject to additional privacy, confidentiality, access, disclosure, security and retention requirements under applicable law or separate Ignis Rose Care policies, notices, consents or authorizations.
Different categories of information may be subject to different legal requirements. For example, ordinary Website information, consumer health data, health care information governed by Washington law, protected health information subject to HIPAA where applicable, and employment-related information may each be subject to different rights, restrictions and obligations.
Accordingly, a right, requirement or protection described in one part of this Privacy Policy should not be interpreted as applying automatically to every category of information maintained by Ignis Rose Care. Where a separate privacy notice, health-information notice, authorization, consent or other legally required document applies to particular information or processing, that document will apply in addition to this Privacy Policy and will govern to the extent required by applicable law.
3. Categories of Personal Information we Collect
The categories of personal information collected by Ignis Rose Care depend on the nature of the individual’s interaction with the Website and the purpose for which the information is provided. Ignis Rose Care seeks to collect only the information reasonably necessary to administer the relevant enquiry, referral, assessment request, communication or other Website function.
- Identification and Contact Information: Ignis Rose Care may collect basic identification and contact information, including an individual’s name, telephone number, email address, street address, city, state and ZIP Code. Where relevant to the particular Website interaction, Ignis Rose Care may also collect information concerning the individual’s relationship to a person seeking services, including whether the individual is the prospective client, a family member or friend, a responsible party, an authorized or legal representative, a healthcare professional or provider, a representative of a senior-care or community organization, or another person involved in arranging, coordinating or facilitating care. This information may be used to understand the context of the enquiry, identify the appropriate person with whom to communicate and, where appropriate, determine whether additional verification of identity, relationship or authority is required.
- Prospective-Client Information: Where an enquiry concerns potential home-care services, Ignis Rose Care may collect information reasonably necessary to understand the prospective client’s circumstances and determine whether further contact, assessment or intake may be appropriate. This may include the prospective client’s identity and contact information, residential location, general description of care needs, services requested, preferred commencement date, desired care schedule, responsible-party information and other limited information relevant to the preliminary enquiry. Information collected through the Website at this stage is intended to support an initial enquiry only. It is not intended to constitute a complete client assessment, formal intake record or plan of care, and submission of the information does not establish a client-care relationship with Ignis Rose Care. Where additional information is required to assess the prospective client’s needs or suitability for services, Ignis Rose Care may obtain that information separately through the appropriate assessment or intake process.
- Referral Information: Where a referral is submitted through the Website, Ignis Rose Care may collect information concerning the prospective client, the individual or organization making the referral and, where applicable, another primary contact or representative. Information concerning the prospective client may include the client’s name, date of birth, telephone number, secondary telephone number, street address, city, state, ZIP Code, primary-contact information, a general description of the reason for referral or services requested, preferred commencement date, referral urgency and any additional comments reasonably relevant to the referral. Information concerning the referring party may include the name of a healthcare provider, facility, agency, senior-care organization or other referring organization, together with the name, telephone number and email address of the relevant contact person. The referral process may also collect information concerning the referring party’s relationship to the prospective client and confirmation as to whether the prospective client or an authorized representative is aware of the referral or has authorized Ignis Rose Care to make contact. Where appropriate, Ignis Rose Care may use this information to review the referral, communicate with the relevant parties, determine whether further assessment may be appropriate and administer subsequent referral or intake activities.
- Assessment Request Information: Where a prospective client, responsible party or other authorized person requests a free or initial assessment through the Website, Ignis Rose Care may collect information necessary to administer that request. This may include the prospective client’s name, email address, telephone number, city, state, ZIP Code, a brief description of care needs, desired commencement date and preferred care schedule. Where the request is submitted by a responsible party or another person assisting the prospective client, Ignis Rose Care may also collect that person’s name, relationship to the prospective client, telephone number, email address, location and other information reasonably necessary to understand and administer the request. Assessment-request information collected through the Website remains preliminary. More detailed health, functional, medical or care-related information may be collected separately where necessary as part of the formal assessment or intake process.
- Payment and Coverage Information: At the preliminary enquiry or referral stage, Ignis Rose Care may collect limited information concerning the anticipated source of payment for services. This may include an indication that services are expected to be funded through private pay, long-term care insurance or an applicable waiver program, veterans'’benefits, another identified source, or an as-yet undetermined payment source. The collection of this information is intended to assist with preliminary service and intake planning only and does not constitute verification of eligibility, insurance coverage, benefits, authorization, reimbursement or payment. The Website is not presently intended to collect detailed insurance policy numbers, member identification numbers, copies of insurance documentation, bank account information, payment-card details or other extensive financial information at the preliminary Website stage. Where additional insurance, benefits, payment or reimbursement information is required, Ignis Rose Care may collect it separately during the applicable assessment, intake, billing or service-administration process and subject to the privacy and security requirements applicable to that information.
- Responsible-Party and Representative Information: Where a prospective client is assisted or represented by another individual, Ignis Rose Care may collect information concerning that person, including their name, contact details, relationship to the prospective client and, where appropriate, information concerning their authority to act for, assist or communicate on behalf of the prospective client. Depending on the circumstances, Ignis Rose Care may request further information or documentation where reasonably necessary to verify the identity, relationship or authority of a responsible party, authorized representative or legal representative before disclosing confidential information, accepting instructions or taking substantive action on the person’s behalf. The receipt of information from a person purporting to act on behalf of another individual does not, by itself, constitute confirmation that the person has authority to exercise all legal, healthcare, contractual or privacy rights on behalf of that individual.
- Communications and Correspondence: Ignis Rose Care may collect and retain information contained in communications sent to or received from users in connection with the Website or related administrative processes. This may include Website messages, emails, referral correspondence, assessment-related communications, follow-up enquiries and other communications concerning prospective services, employment opportunities or other requests. The nature of the information collected will depend on the content voluntarily provided by the sender. Users should avoid including personal, medical or other sensitive information that is not reasonably necessary for the relevant communication.
- Email and Text Communication Preferences: Certain Website forms may allow individuals to indicate whether they wish to receive email or text communications from Ignis Rose Care. In that context, Ignis Rose Care may collect and maintain information concerning the communication channel selected, whether consent or permission was provided, the date and method by which a preference was expressed, subsequent changes to communication preferences, unsubscribe or opt-out requests and other records reasonably necessary to administer communications and demonstrate compliance with applicable legal requirements. Where separate consent is required for promotional or marketing communications, Ignis Rose Care will seek that consent separately and will not treat the mere provision of contact information or submission of a Website form as sufficient consent where applicable law requires an additional affirmative action.
- Document Acceptance and Acknowledgement Records: Where the Website presents Terms and Conditions, a privacy or health-information notice or another document for acceptance or acknowledgement, Ignis Rose Care may maintain records relating to that interaction. Depending on the relevant process, those records may include the date and time of the interaction, the version of the document presented, the acceptance or acknowledgement recorded and other limited information reasonably necessary to evidence the interaction.
- Other Information Voluntarily Provided: Ignis Rose Care may also collect other information that an individual voluntarily chooses to provide through a Website form or related communication. Because certain Website forms contain free-text fields, the precise content of such information cannot always be determined in advance. Ignis Rose Care does not intend those fields to be used for the submission of unnecessary sensitive information, complete medical records or other extensive confidential material. Where additional information is required for a specific assessment, intake, employment or service purpose, Ignis Rose Care may request that the information be provided separately through an appropriate process.
4. Health-Related and Care Information
- Health-Related Information Collected Through the Website: Because the Website facilitates enquiries, referrals and requests for home-care services, Ignis Rose Care may collect limited information concerning a prospective client’s health, functional abilities, care requirements or other circumstances relevant to the need for assistance. This information may include a general description of care needs, the reason for a referral, mobility or functional support requirements, personal-care needs, assistance with activities of daily living, the urgency or timing of requested services and other information reasonably necessary to understand and respond to an enquiry, referral or assessment request. The nature and sensitivity of the information collected will depend on the relevant Website interaction and the information provided by the user.
- Data Minimization and Subsequent Assessment: Ignis Rose Care seeks to limit health-related information collected through its public Website to information reasonably necessary at the preliminary enquiry, referral or assessment-request stage. Detailed information concerning diagnoses, medical history, medications, treatment or other clinical matters will generally be collected separately where necessary through the appropriate assessment, intake or care-planning process. Information collected through those subsequent processes may be subject to additional privacy, confidentiality, security, access, disclosure and retention requirements under applicable federal or Washington law.
- Sensitive Information Submitted Through the Website: The public Website is not intended to serve as a general repository for complete medical records or extensive clinical information. Unless specifically requested through an appropriate process, users should provide only the information reasonably necessary for Ignis Rose Care to understand and respond to the relevant enquiry, referral or assessment request. The legal protections applicable to health-related information will depend on the nature of the information and the circumstances in which it is collected, maintained and used. The specific requirements applicable to protected health information, Washington health care information and consumer health data are addressed in Sections 19, 20 and 21 of this Privacy Policy.
5. Information Voluntarily Provided in Free-Text Fields
- Free-Text Submissions: Certain Website forms contain free-text fields that allow users to provide messages, describe care needs, explain the reason for a referral or provide additional information relevant to an enquiry or assessment request. Because the content of these fields is determined by the user, Ignis Rose Care may receive personal, health-related, financial or other sensitive information that it did not specifically request.
- Limitation on Information Submitted: The availability of a free-text field does not constitute a request for unrestricted sensitive information. Users should limit the information provided to what is reasonably necessary for the relevant Website interaction and should not submit Social Security numbers, financial-account information, authentication credentials, complete medical records or other highly sensitive information unless Ignis Rose Care has specifically requested it through an appropriate process.
- Unsolicited Information: Where a user voluntarily provides sensitive information that Ignis Rose Care did not specifically request, Ignis Rose Care may process that information to the extent reasonably necessary to review and respond to the relevant communication and as otherwise permitted or required by applicable law. Where additional sensitive information is required for an assessment, intake, care, recruitment or other formal process, Ignis Rose Care may request that the information be provided separately through an appropriate method.
6. Information we Receive From Other People
- Information Provided by Third Parties: Ignis Rose Care may receive personal information about a prospective client from a person other than the prospective client. This may occur where another individual or organization is involved in arranging, coordinating, referring or facilitating potential home-care services. Depending on the circumstances, information may be provided by a family member, friend, responsible party, authorized representative, legal representative, healthcare professional, healthcare provider, healthcare facility, senior-care organization, community organization or another person or entity appropriately involved in the prospective client’s care or referral.
- Nature of Information Received: Information received from a third party may include the prospective client’s identification and contact details, date of birth, residential location, general care needs, reason for referral, requested services, preferred commencement date, urgency of the referral, anticipated payment source and information concerning the identity and contact details of a responsible party or other representative. The precise nature of the information received will depend on the purpose of the referral or enquiry and the information provided by the third party.
- Authority to Provide Information: Where a person submits personal information concerning another individual, Ignis Rose Care expects that person to be appropriately authorized, or otherwise lawfully permitted, to provide the information for the purpose for which it is submitted. Where the applicable Website form requires the referring person to confirm that the prospective client or an authorized representative is aware of the referral or has authorized Ignis Rose Care to make contact, Ignis Rose Care may rely on that confirmation for the limited purpose of administering the referral, subject to any additional verification that may be appropriate in the circumstances. The submission of information by a third party does not, by itself, establish that the person has authority to exercise all legal, healthcare, contractual or privacy rights on behalf of the individual concerned.
- Verification of Identity and Authority: Where reasonably necessary, Ignis Rose Care may take steps to verify the identity of the person providing information, the nature of that person’s relationship to the prospective client or the authority on which the person purports to act. Such verification may be required before Ignis Rose Care discloses confidential information, accepts instructions, proceeds with an assessment, responds to a privacy request or takes another substantive action relating to the prospective client. The nature and extent of any verification will depend on the circumstances, the sensitivity of the information involved and the legal requirements applicable to the relevant interaction.
- Use of Third-Party Information: Information received from another person may be used for purposes reasonably connected with the relevant referral, enquiry or request, including reviewing the prospective client’s needs, contacting the prospective client or an appropriate representative, arranging an assessment, determining whether Ignis Rose Care may be able to provide services and administering related intake or care-coordination activities. Where information received from a third party is later incorporated into a formal client, care or health-information record, it may become subject to additional privacy, confidentiality, access, disclosure and retention requirements.
- Privacy and Confidentiality Obligations: The fact that personal information has been provided to Ignis Rose Care by a third party does not limit or transfer any independent privacy, confidentiality, security, verification or health-information obligation applicable to Ignis Rose Care. Ignis Rose Care will handle information received from third parties in accordance with the legal and regulatory requirements applicable to the particular information and circumstances, including any requirement to verify authority, restrict disclosure, obtain additional consent or authorization, or protect the confidentiality of the information.
7. Employment and Applicant Information
- Preliminary Employment Enquiries: The Website may permit individuals to express interest in employment, caregiving or other work opportunities with Ignis Rose Care through a “Join Our Team” form or similar recruitment enquiry function. At this preliminary stage, Ignis Rose Care may collect information reasonably necessary to understand the individual’s interest and determine whether further recruitment contact may be appropriate. This may include the applicant’s name, telephone number, email address, street address or general location, relevant caregiving experience, position or type of work of interest, preferred times for follow-up contact and information concerning how the applicant became aware of Ignis Rose Care. Information submitted through the Website at this stage is intended to support a preliminary recruitment enquiry only and is not intended to constitute a complete employment application or formal onboarding record.
- Information Not Intended to Be Collected Through the Website: The public-facing recruitment form is not presently intended to collect Social Security numbers, employment eligibility documentation, copies of passports, driver’s licenses or other identification documents, formal background-check information, financial account information, detailed medical information or disability-related information. Applicants should not submit such information through the public Website unless Ignis Rose Care specifically requests that it be provided through an appropriate process. The availability of a free-text field or general recruitment enquiry form does not constitute a request for applicants to disclose sensitive personal information that is not reasonably necessary at the preliminary enquiry stage.
- Formal Recruitment and Onboarding Information: Where an individual progresses beyond the preliminary enquiry stage, Ignis Rose Care may collect additional information and documentation reasonably necessary to assess the individual’s suitability for the relevant role, administer the recruitment process and comply with applicable legal, regulatory or licensing requirements. Depending on the role and stage of recruitment, such information may include employment history, references, professional qualifications, licenses, certifications, training records, employment eligibility information, identity documentation and information required for lawful background or screening processes. Additional information may also be collected where necessary for payroll, tax, benefits, scheduling, workforce administration or other employment-related purposes after an employment relationship is established. Such information will generally be collected through a separate recruitment, screening or onboarding process rather than through the preliminary Website enquiry form.
- Background Checks and Screening: Where background checks, credential verification, reference checks or other pre-employment screening are required, Ignis Rose Care may collect or receive information through the applicable recruitment process and from authorized third-party providers or other lawful sources. Any background-check or screening process will be conducted subject to the notices, consents, authorizations and other requirements applicable under federal and Washington law. Submission of a Website employment enquiry does not itself constitute consent to a background check or other screening activity.
- Health and Disability Information Ignis Rose Care does not intend to collect detailed health or disability information from applicants through the public Website. Where health, disability, accommodation or fitness-related information is lawfully requested or voluntarily provided during a later recruitment or employment process, such information may be subject to additional confidentiality, access and use restrictions under applicable employment, disability, privacy or other law. Any request for disability-related or medical information will be handled separately from the preliminary Website enquiry process and only where appropriate and legally permitted.
- Use of Applicant Information: Applicant information may be used to review and respond to expressions of interest, assess qualifications and experience, communicate with applicants, arrange interviews or follow-up discussions, administer recruitment and onboarding, verify information where appropriate, comply with legal and regulatory requirements, maintain recruitment records and establish, exercise or defend legal rights. Ignis Rose Care will not treat information collected for recruitment purposes as unrestricted permission to use that information for unrelated purposes.
- Recruitment Communications and Document Exchange: Formal recruitment documents may be exchanged through Ignis Rose Care’s business email system or another designated recruitment or onboarding process. Where an applicant is asked to provide additional documentation, Ignis Rose Care may identify the appropriate method for providing that information. Applicants should use the method specified and should avoid transmitting highly sensitive documentation through ordinary Website forms unless specifically instructed to do so.
- Retention of Applicant Information: Applicant information may be retained for a period reasonably necessary to administer the recruitment process, comply with applicable recordkeeping requirements, respond to potential disputes or legal claims and satisfy other legitimate employment-related purposes. Where an applicant is hired, relevant recruitment information may become part of the individual’s employment or personnel record and may thereafter be subject to the retention requirements applicable to that record. Where an applicant is not hired, the applicable retention period may differ and will be determined in accordance with Ignis Rose Care’s retention practices and applicable law.
- Separate Treatment of Employment Information: Information collected from an individual in an employment or applicant context is treated separately from information collected concerning prospective or existing clients. Applicant and employment information may therefore be subject to different privacy, confidentiality, access, disclosure and retention requirements from those applicable to client, health-related or consumer health data. Nothing in this Privacy Policy should be interpreted as applying client-care privacy requirements automatically to employment information, or employment privacy requirements automatically to client information, where the relevant legal regimes differ.
8. Information Collected Automatically
- Technical and Usage Information: When a user accesses or interacts with the Website, certain technical and usage information may be collected automatically by the Website, the hosting environment or other service providers involved in delivering, maintaining, securing or supporting Website functionality. Depending on the technology used, this information may include the user’s Internet Protocol address, browser type and version, device type, operating system, date and time of access, pages or resources requested, referring webpage or source, technical request information, server logs, error reports, security-event data and location or approximate location information associated with a Website interaction or form submission.
- Purposes of Automatic Collection: Ignis Rose Care may use automatically collected information where reasonably necessary to operate, maintain and secure the Website, ensure that Website content and functionality are delivered properly, diagnose technical faults, investigate errors, monitor system performance, prevent or detect misuse, protect against unauthorized access or malicious activity, maintain appropriate security records and comply with applicable legal or regulatory obligations. Such information may also be used in aggregate or de-identified form to understand general Website performance and usage patterns, provided that such use is consistent with applicable law and does not involve the use of identifiable health-related information for unrelated purposes. Ignis Rose Care may also use limited Website usage and analytics information to understand how visitors interact with the Website, measure Website performance and improve Website content and functionality.
- Hosting and Infrastructure Data: Certain technical information may be processed through the WordPress Website and by the third-party hosting provider that hosts and supports the Website and its database. Such information may include Internet Protocol addresses, request information, browser or device information, technical logs, error information and security-related information generated through ordinary Website operation. This processing supports Website delivery, availability, maintenance, troubleshooting and security.
- Cookies and Similar Technologies:> Some automatically collected information may be generated through cookies, local storage, server-side logs or similar technologies used for essential Website functionality, security or technical administration. The specific use of cookies and similar technologies, including analytics technologies currently used by the Website, is addressed further in section 9 of this Privacy Policy. Where non-essential analytics or tracking technologies are introduced in the future, Ignis Rose Care will update its privacy disclosures and implement any consent or preference mechanism required by applicable law.
- Advertising and Profiling: Ignis Rose Care does not currently use automatically collected Website information to conduct behavioral advertising based on an individual’s health status, care needs or other health-related characteristics. Ignis Rose Care also does not currently use Meta/Facebook Pixel or another identified advertising-tracking technology to create advertising profiles based on Website users’ enquiries, referrals, assessment requests or other care-related interactions. If these practices change in the future, Ignis Rose Care will review the applicable privacy and consumer health data requirements and update this Privacy Policy and any required consent mechanisms before or when the relevant processing begins.
- Relationship to Health and Consumer Health Data: Automatically collected technical information will not necessarily constitute health-related information or consumer health data merely because it is generated when a user visits the Website. However, depending on the circumstances and the manner in which technical information is linked, inferred or associated with a user’s interaction with care-related content or services, additional privacy obligations may apply. Ignis Rose Care will assess automatically collected information according to its nature, context and use and will apply any additional protections required under applicable federal or Washington law.
9. Cookies and Similar Technologies
- Use of Cookies and Similar Technologies: The Website uses cookies and similar technologies to support Website functionality, security, remember user choices and understand how visitors interact with the Website. These include essential or functional cookies required for Website operation and analytics cookies used in connection with Google Analytics, subject to any applicable consent or preference requirements.
- Essential and Functional Technologies: Certain cookies or similar technologies may be necessary for the Website to function properly and may therefore operate without a separate user preference where permitted by applicable law. These technologies may be used to maintain Website functionality, support secure connections, remember technical settings, enable requested features, protect against malicious activity and assist with troubleshooting or performance management. Where a technology is strictly necessary for the operation or security of the Website, disabling that technology may affect the availability or functionality of certain Website features. The Website may use a functional cookie to remember that a visitor has accepted the Website Terms and Conditions. This cookie is used for Website administration and to avoid unnecessarily requesting repeated acceptance and is not used for advertising or behavioural tracking.
- Analytics Technologies: Ignis Rose Care uses Google Analytics to understand how visitors interact with the Website and to monitor and improve Website performance and content. Google Analytics may collect information including Internet Protocol address, browser and device information, pages visited, referring sources, approximate geographic information and other Website interaction or usage information. Where applicable consent is required for analytics cookies or similar technologies, those technologies will be activated only in accordance with the user’s selections through the Website’s cookie preference mechanism.
- Advertising and Tracking Technologies: Ignis Rose Care does not currently use Meta/Facebook Pixel or another advertising-tracking technology to conduct targeted or behavioral advertising based on Website users’ care needs, referral activity, assessment requests or other health-related interactions. If Ignis Rose Care introduces material advertising or tracking technologies in the future, it will update its privacy disclosures and implement any notice, consent or other mechanism required by applicable law.
- Third-Party Embedded Content and Links: The Website may contain embedded content from, or links to, third-party platforms such as video-hosting, social-media, scheduling or other external services. When a user interacts with such content or follows a link to a third-party platform, that third party may use cookies or similar technologies independently of Ignis Rose Care. The collection and use of information by those third parties may be governed by their own privacy policies, cookie notices and terms of use. Ignis Rose Care does not control the independent use of cookies or similar technologies by third-party platforms, except to the extent that applicable law imposes responsibility on Ignis Rose Care in relation to its own use or integration of those services.
- Cookie Choices and Controls: Where required or otherwise implemented by Ignis Rose Care, the Website provides a cookie banner or preference-management mechanism through which users can make or change choices regarding non-essential cookies and similar technologies. Essential or strictly necessary technologies may operate without a separate choice where permitted by applicable law.
- Consumer Health Data Considerations: Ignis Rose Care does not intend to use cookies or similar technologies to sell consumer health data, share consumer health data for unrelated advertising purposes or infer sensitive health characteristics for targeted advertising. Where information generated through cookies or similar technologies is capable of being linked or associated with a user’s health-related Website activity, Ignis Rose Care will assess whether that information is subject to additional requirements under applicable Washington consumer health data law and will apply any required notice, consent, disclosure or other protections.
- Changes to Cookie Practices: Ignis Rose Care may change the cookies or similar technologies used by the Website as Website functionality, technology providers or business practices evolve. Where a change materially affects the collection or use of personal information, Ignis Rose Care will update this Privacy Policy and any related cookie notice or consent mechanism as required by applicable law before or when the relevant processing begins.
10. Sources of Personal Information
- Information Provided Directly by Individuals: Ignis Rose Care may collect personal information directly from the individual to whom the information relates. This may occur when a person submits a general enquiry, requests a free or initial assessment, provides information concerning prospective home-care services, expresses an interest in employment, communicates with Ignis Rose Care by email or telephone, submits feedback or a testimonial, selects communication preferences, or otherwise interacts with the Website or with Ignis Rose Care in connection with a Website-based request. The nature of the information collected directly will depend on the particular interaction and may include identification and contact information, general information concerning care needs, preferred service arrangements, employment-related information, communication preferences and other information voluntarily provided by the individual.
- Information Provided by Family Members: Friends and Responsible Parties. Ignis Rose Care may receive personal information concerning a prospective client from a family member, friend, responsible party or other individual assisting with the arrangement or coordination of care. This may occur, for example, where another person submits an enquiry on behalf of the prospective client, requests an assessment, provides responsible-party contact information or assists with an initial referral. The information provided may include the prospective client’s name and contact details, location, general care needs, requested services, preferred commencement date, desired care schedule and other information reasonably relevant to the enquiry. Where appropriate, Ignis Rose Care may also collect information concerning the identity of the person providing the information, their relationship to the prospective client and the basis on which they are acting or communicating on that person’s behalf.
- Information Provided by Authorized or Legal Representatives: Personal information may also be provided by an authorized representative, legal representative or other person lawfully permitted to act for an individual. Depending on the circumstances, such a person may provide information in connection with a referral, assessment request, service enquiry, privacy request or other interaction with Ignis Rose Care. Where reasonably necessary, Ignis Rose Care may request information sufficient to verify the identity or authority of the representative before relying on instructions, disclosing confidential information or taking substantive action in relation to the individual concerned.
- Information Provided by Healthcare Professionals and Other Referral Sources: Ignis Rose Care may receive personal information from healthcare professionals, healthcare providers, facilities, senior-care organizations, agencies, community organizations and other persons or entities involved in referring or assisting a prospective client. Information received from a referral source may include identifying and contact information concerning the prospective client, date of birth, residential location, a general description of care needs, services requested, referral urgency, preferred commencement date, primary-contact information, anticipated payment source and other information reasonably necessary to understand and administer the referral. Ignis Rose Care may also collect identifying and contact information concerning the referring professional, organization or individual and, where applicable, information confirming whether the prospective client or an authorized representative is aware of the referral or has authorized contact by Ignis Rose Care.
- Information Provided by Employment Applicants: Ignis Rose Care may collect information directly from individuals who express an interest in employment or caregiving opportunities through the Website or through subsequent recruitment communications. At the preliminary Website stage, this may include the applicant’s name, telephone number, email address, address or location, caregiving experience, position of interest, preferred times for follow-up contact and information concerning how the applicant became aware of Ignis Rose Care. Where an applicant progresses through recruitment or onboarding, additional information may be collected separately from the applicant or from other lawful sources, such as references, credentialing sources or authorized background-check providers, subject to applicable legal requirements.
- Information Generated Through Subsequent Communications: Ignis Rose Care may collect additional personal information through correspondence and communications that occur after an initial Website interaction. For example, information may be generated or received through follow-up emails, telephone conversations, referral correspondence, assessment scheduling, recruitment communications, privacy enquiries or other administrative interactions. Such information may include clarification of previously submitted information, updated contact details, additional information concerning a request or records of communications between Ignis Rose Care and the relevant individual or representative. Where an enquiry progresses to a formal assessment, intake, client-care or employment process, additional information may thereafter be collected under the separate procedures and privacy requirements applicable to that relationship.
- Information Collected Automatically Through Website Technology: Certain technical and usage information may be collected automatically when an individual accesses or interacts with the Website. Such information may be generated by the Website itself or by third-party providers involved in hosting, operating, securing or maintaining Website functionality. Depending on the technology involved, this may include Internet Protocol addresses, browser or device information, operating-system information, dates and times of access, requested pages or resources, referring webpages, approximate location information, technical request information, server logs, security information, analytics information and error data. Automatically collected information may also be generated through Website analytics services, including Google Analytics, as described in Section 9.
- Information Processed Through Service Providers: Ignis Rose Care may receive, access or otherwise process personal information through service providers supporting Website hosting, Website forms, data storage, business email, analytics, communications, security and related administrative functions. Website form submissions are processed through the Website platform, stored within the Website database and transmitted to Ignis Rose Care’s designated business email address. Where a service provider processes information on behalf of Ignis Rose Care, Ignis Rose Care will address the privacy, confidentiality, security and contractual requirements applicable to its use of that provider.
- Nature of the Source Depends on the Relationship: The source of personal information will depend on the nature of the individual’s relationship with Ignis Rose Care and the context in which the information is collected. In some cases, the same individual’s information may be received from more than one source. For example, a prospective client may provide information directly while additional referral information is received from a healthcare provider or responsible party. Ignis Rose Care will consider the source and context of information when determining how it may lawfully be used, disclosed, verified, retained and protected. The receipt of information from a third party does not reduce any independent privacy, confidentiality or verification obligations applicable to Ignis Rose Care.
11. How we use Personal Information
- General Purposes: Ignis Rose Care uses personal information only for purposes that are reasonably connected with the circumstances in which the information was collected, for compatible purposes permitted by applicable law, or where the individual has otherwise been informed of, requested or authorized the relevant use. The specific purposes for which personal information is used will depend on the nature of the individual’s interaction with Ignis Rose Care and the type of information involved.
- Enquiries, Referrals and Assessment Requests: Ignis Rose Care may use personal information to receive, review and respond to general enquiries, prospective-client enquiries, referrals and requests for free or initial assessments. Any more detailed health, care or other sensitive information collected at that stage will be handled in accordance with the additional legal, regulatory and privacy requirements applicable to that information.
- Employment and Recruitment: Ignis Rose Care may use information provided by employment applicants to review and respond to employment enquiries, assess an individual’s suitability for available roles, communicate regarding recruitment opportunities, arrange interviews or follow-up discussions and administer recruitment and onboarding activities. This may include investigating suspected fraud, misuse, unauthorized access, security threats or other conduct that may expose individuals or Ignis Rose Care to harm or legal risk.
- Other Uses and Changes of Purpose: Ignis Rose Care does not treat the collection of personal information for one purpose as unrestricted permission to use that information for unrelated purposes. Where Ignis Rose Care proposes to use personal information for a purpose that is materially different from the purpose for which it was originally collected, it will assess whether the new purpose is compatible with the original purpose and whether any additional notice, consent or authorization is required under applicable law. Where such additional notice, consent or authorization is required, Ignis Rose Care will provide or obtain it before undertaking the relevant use.
12. How we Disclosure Personal Information
- General Approach to Disclosure: Ignis Rose Care may disclose personal information where reasonably necessary to administer the purpose for which the information was collected, provide or arrange requested services, operate and support the Website and related business functions, comply with applicable legal or regulatory requirements, protect legitimate rights and interests, or as otherwise permitted or authorized by applicable law. Ignis Rose Care does not treat possession of personal information as unrestricted authority to disclose that information. The nature and extent of any disclosure will depend on the purpose for which the information is held, the sensitivity of the information involved, the recipient and any applicable confidentiality, privacy, health-information or consent requirements.
- To Whom We May Disclose Personal Information: Depending on the circumstances, Ignis Rose Care may disclose personal information to service providers and contractors that support its Website, form processing, data storage, business email, analytics, communications, information technology, security and other operational or administrative functions. - Service Providers: Ignis Rose Care may engage third-party service providers to perform functions on its behalf. These providers may process personal information where necessary to provide hosting, form-processing, storage, email, analytics, communications, information-technology, security or related services. Where appropriate, Ignis Rose Care seeks to limit the information provided to service providers to what is reasonably necessary for the relevant service and to use providers subject to applicable contractual, confidentiality, privacy or security obligations.
- Care, Referral and Service Administration: Where an enquiry, referral or assessment progresses toward the provision of services, personal information may be disclosed to persons involved in reviewing, arranging, coordinating or administering the relevant care or services. Depending on the circumstances, this may include the prospective client, an authorized representative, responsible party, healthcare professional, healthcare provider, referral source or other appropriate participant. Any disclosure of health-related or confidential information will be subject to the legal requirements applicable to that information, including any requirement for consent, authorization or verification of the recipient’s authority.

Any disclosure under this subsection will be limited to what is reasonably appropriate in the circumstances and subject to applicable law.
- Business Transactions: If Ignis Rose Care is involved in a proposed or completed merger, acquisition, financing, reorganization, sale of assets, transfer of operations or similar business transaction, personal information may be disclosed to prospective or actual purchasers, investors, lenders, professional advisers and other appropriate transaction participants where reasonably necessary for evaluating, negotiating or completing the transaction. Any such disclosure will remain subject to applicable confidentiality, privacy, health-information and security requirements.

Where applicable law requires a specific form of consent or authorization before particular information may be disclosed, including certain health-related information or consumer health data, Ignis Rose Care will obtain the required consent or authorization before making the disclosure.
- Limitation on Disclosures: Ignis Rose Care seeks to disclose only the personal information reasonably necessary for the relevant purpose and to restrict access to recipients who have an appropriate need or lawful basis to receive it. Where personal information is subject to additional protections under federal or Washington law, including applicable health-information or consumer health data requirements, those requirements will govern the disclosure in addition to the provisions of this Privacy Policy.

The categories of personal information collected by Ignis Rose Care are described more fully elsewhere in this Privacy Policy.
- Sensitive and Health-Related Information: Certain Website forms or submission fields may permit or require users to provide information that is sensitive or health-related in nature. Users should provide only the information reasonably necessary for the relevant purpose and should avoid submitting extensive medical, financial, identification or other highly sensitive information unless Ignis Rose Care has specifically requested it through an appropriate process. Any health-related, consumer health or other protected information received through the Website will be handled in accordance with the legal requirements applicable to that information.
- Information Associated With Website Submissions: Ignis Rose Care may collect or generate technical and administrative information in connection with a Website submission. Further information concerning automatically collected information and cookies or similar technologies is provided elsewhere in this Privacy Policy.
- Storage, Access and Security: Information submitted through the Website may be stored within Ignis Rose Care’s Website, database, business communication or other authorized systems and may also be processed by service providers acting on its behalf. Access is intended to be limited to personnel, contractors and service providers who require access for legitimate business, operational, technical, legal, regulatory or service-related purposes. Ignis Rose Care applies reasonable administrative, technical and organizational safeguards appropriate to the nature and sensitivity of the information involved..
14. Website Hosting and Technology Providers
- Hosting and Infrastructure: Ignis Rose Care uses third-party technology providers to host, operate, maintain, secure and support the Website and its underlying infrastructure. In providing those services, such providers may process technical, operational and other information reasonably necessary to deliver, maintain, troubleshoot and secure the Website. - Use of Business Email and Communication Systems: Information initially submitted through the Website may subsequently be communicated, reviewed or otherwise processed through Ignis Rose Care’s business email and other authorized communication systems where reasonably necessary to respond to enquiries, administer referrals, arrange assessments, communicate with prospective clients, responsible parties or referral sources, correspond with employment applicants, or undertake other legitimate administrative activities. The nature of the information processed through these systems will depend on the relevant interaction. It may include contact information, referral or assessment-related correspondence, scheduling information, employment communications and other information reasonably necessary to administer the applicable request or relationship.
- Recruitment Communications: Individuals who express an interest in employment through the Website may be contacted separately through Ignis Rose Care’s business email system or another designated recruitment process. Where an applicant progresses beyond the preliminary enquiry stage, Ignis Rose Care may request formal application materials, supporting documents or other recruitment information through a separate communication channel rather than through the public Website form. Applicants should provide sensitive recruitment or onboarding information only through the method identified by Ignis Rose Care for that purpose.
- Sensitive and Health-Related Information: Ordinary email may not provide the same level of protection as a purpose-built secure system designed for the transmission of sensitive health or other confidential information. Users should therefore avoid sending complete medical records, extensive medical histories, detailed treatment information, Social Security numbers, financial account information or other highly sensitive information by ordinary email unless Ignis Rose Care has specifically requested the information and identified email as an appropriate means of providing it. Where more detailed health, medical or other sensitive information is required for assessment, intake, care planning, employment or another formal process, Ignis Rose Care may direct the individual to provide that information through a more appropriate process or communication method.
- Security and Appropriate Use: Ignis Rose Care seeks to apply reasonable administrative and technical safeguards to its business communication systems and to limit access to communications containing personal information to personnel or other authorized persons who require access for legitimate purposes. However, no method of electronic communication can be guaranteed to be completely secure. Individuals should therefore exercise appropriate care when transmitting sensitive information electronically and should follow any specific instructions provided by Ignis Rose Care concerning the appropriate method for submitting particular categories of information.
- Other Communication Platforms: Ignis Rose Care may use additional authorized communication platforms from time to time where reasonably necessary for operational, administrative, recruitment or service-related purposes. These communications may include responses to enquiries, appointment and assessment information, referral communications, service-related correspondence, recruitment communications, privacy or security notices and other administrative communications reasonably connected with the individual's interaction with Ignis Rose Care.
- Email and Text Communication Preferences: Certain Website forms may provide individuals with separate options to indicate whether they wish to receive communications from Ignis Rose Care by email and/or text message. Where such options are presented, Ignis Rose Care will use the individual's selections to record and manage their communication preferences and, where applicable, their consent to communications through the selected method.
- Consent Where Required: Where applicable law requires consent before Ignis Rose Care may send a particular type of email or text message, Ignis Rose Care will request that consent separately through an affirmative choice. Visiting or using the Website, viewing this Privacy Policy, submitting a Website form, or providing an email address or telephone number does not, by itself, constitute consent to receive communications for which separate consent is required.
- Marketing and Promotional Communications: Ignis Rose Care will send marketing or promotional communications by email or text message only where permitted by applicable law and, where consent is required, after obtaining the individual's consent. Consent to receive marketing or promotional communications is voluntary and is not a condition of submitting an enquiry, applying for employment or requesting services from Ignis Rose Care.
- SMS Opt-In Information: Ignis Rose Care does not sell, rent or share an individual’s mobile telephone number, SMS opt-in information or consent to receive text messages with third parties for their own marketing or promotional purposes. Such information may be disclosed to service providers that assist Ignis Rose Care in delivering or administering text communications on its behalf, subject to appropriate privacy, confidentiality and security requirements.
- Withdrawal of Consent and Communication Preferences: An individual may withdraw consent or change their email or text communication preferences at any time by using an unsubscribe or opt-out method provided in the relevant communication, where available, or by contacting Ignis Rose Care using the contact details provided in this Privacy Policy. Ignis Rose Care will process such requests in accordance with applicable law. Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal.
- Non-Marketing Communications: A decision not to consent to, or to opt out of, marketing or other optional communications will not prevent Ignis Rose Care from sending non-marketing communications where reasonably necessary to respond to an individual's request, administer an existing or requested service, communicate regarding an application or recruitment process, address privacy or security matters, or comply with applicable legal or regulatory obligations.
18. Testimonials and Reviews
- Submission of Testimonials and Feedback: Ignis Rose Care may receive testimonials, reviews, comments and other feedback from clients, family members, representatives or other individuals. - Authorization for Publication: Where Ignis Rose Care wishes to publish an identifiable testimonial or review on the Website, social media, marketing materials or another public channel, it will obtain an appropriate Review and Testimonial Release Authorization or other legally sufficient consent or authorization where required. Any authorization will govern the extent to which Ignis Rose Care may identify the individual, reproduce the testimonial and use associated information for the purposes described in the authorization.
- Health-Related and Other Protected Information: Where publication of a testimonial would disclose or permit an inference concerning an individual’s health status, care needs, receipt of services or other legally protected information, Ignis Rose Care will obtain any additional authorization required under applicable privacy or health-information law before publication. Ignis Rose Care will not treat general acceptance of this Privacy Policy, the Website Terms and Conditions or another general Website document as authorization to publish protected health information or other information for which a separate authorization is legally required.
- Editing and Presentation of Testimonials: Where permitted by the applicable authorization, Ignis Rose Care may make reasonable edits to a testimonial for spelling, grammar, length, formatting or clarity, provided that such edits do not materially alter the substance or meaning of the individual’s statement.
- Withdrawal and Removal: Where the applicable testimonial authorization or applicable law permits an individual to withdraw consent to continued publication, Ignis Rose Care will process a valid withdrawal request in accordance with the terms of the authorization and applicable law. Withdrawal will apply prospectively to continued use to the extent reasonably practicable and legally required, but may not require the recovery or removal of materials already lawfully distributed or otherwise outside Ignis Rose Care’s reasonable control.

- Uses and Disclosures of PHI: Ignis Rose Care may use and disclose PHI without a separate written authorization where permitted by HIPAA, including for treatment, payment and healthcare operations and for other purposes expressly permitted or required by law. Where HIPAA requires an individual’s written authorization for a particular use or disclosure, Ignis Rose Care will obtain a valid authorization before undertaking that use or disclosure. Use of the Website, submission of a Website form or acceptance of this Privacy Policy does not constitute a HIPAA authorization where a separate authorization is required.
- Individual Rights: Individuals may have rights under HIPAA in relation to PHI maintained by Ignis Rose Care, including rights to access and obtain copies of certain records, request amendment of information, request confidential communications or restrictions on certain uses or disclosures, and obtain an accounting of certain disclosures, subject to applicable conditions and exceptions. - HIPAA Notice of Privacy Practices: Ignis Rose Care may maintain a separate HIPAA Notice of Privacy Practices that provides additional information concerning permitted uses and disclosures of PHI, Ignis Rose Care’s legal duties and the rights available to individuals under HIPAA. This Website Privacy Policy does not replace the HIPAA Notice of Privacy Practices. Where the Notice of Privacy Practices applies to PHI, it should be read together with this Privacy Policy and will govern to the extent required by HIPAA.
- HIPAA Privacy Contact: Questions concerning PHI, requests to exercise HIPAA rights or complaints concerning Ignis Rose Care’s HIPAA privacy practices may be submitted using the privacy contact details set out in this Privacy Policy. Individuals may also submit a complaint to the U.S. Department of Health and Human Services, Office for Civil Rights. Information submitted through the Website for a preliminary enquiry, referral or assessment request does not automatically constitute a formal client or health-care record. Where such information subsequently becomes part of a client’s assessment, intake, care plan, service record or other health-care record, it will thereafter be handled in accordance with the requirements applicable to that record.
- Use and Disclosure: Health care information maintained as part of Ignis Rose Care’s client and care records will be used and disclosed only as permitted or required by applicable Washington law. Ignis Rose Care will apply applicable confidentiality and disclosure restrictions, obtain authorization where required and limit access to persons authorized to receive the information.

The retention requirements applicable to formal client and care records are addressed further in the Data Retention section of this Privacy Policy.
- Preservation of Washington Law Rights: Nothing in this Privacy Policy is intended to waive, restrict or reduce any confidentiality, access or other right available under Chapter 70.02 RCW or other applicable Washington health-information law. Where a mandatory requirement of applicable Washington law conflicts with this Privacy Policy, the applicable legal requirement will govern.
21. Washington Consumer Health Data Privacy Policy
- Purpose and Scope: This Section constitutes Ignis Rose Care’s Consumer Health Data Privacy Policy for purposes of the Washington My Health My Data Act, Chapter 19.373 RCW (“MHMDA”), to the extent that MHMDA applies to the relevant consumer, information and processing activity. MHMDA applies to certain personal information that is linked or reasonably linkable to a consumer and identifies the consumer’s past, present or future physical or mental health status, including information identifying a consumer as seeking health care services. This Section does not apply to information exempt from MHMDA, including protected health information subject to HIPAA and qualifying health care information collected, used or disclosed in accordance with Chapter 70.02 RCW. It also does not apply to information concerning an individual acting in an employment context.
- Consumer Health Data We May Collect Depending on a consumer’s interaction with the Website, Ignis Rose Care may collect consumer health data concerning an individual’s request for or interest in home-care services. This may include information concerning general care needs, the reason for a referral or assessment request, mobility or functional support requirements, assistance with activities of daily living, personal-care needs, requested or preferred commencement of services, urgency of requested services and other information concerning an individual’s physical or mental condition or need for care or assistance. Consumer health data may also include identifying or contact information, such as a name, telephone number, email address, date of birth or residential information, where that information is associated with information identifying the individual as seeking health care services.
- Purposes for Collection and Use: Ignis Rose Care may collect and use consumer health data where necessary to provide a product or service requested by the consumer, where the consumer has provided any consent required by MHMDA, or where another provision of applicable law permits the processing. Consumer health data may be used to respond to enquiries, review and administer referrals, understand general care requirements, communicate with the consumer or an appropriate representative, arrange assessments, determine whether requested services may be provided, administer subsequent intake activities and maintain records concerning the relevant request. Where MHMDA requires affirmative consent for an additional collection or use, Ignis Rose Care will obtain that consent before the relevant processing occurs.
- Sources of Consumer Health Data: Consumer health data may be collected directly from the consumer or received from a family member, responsible party, authorized or legal representative, healthcare professional, healthcare provider, healthcare facility, senior-care or community organization or other referral source appropriately involved in arranging or facilitating care.
- Service Providers and Processors: Ignis Rose Care uses service providers to support the operation of the Website and the processing, transmission and storage of information submitted through it. Website form submissions are currently processed through Forminator within the WordPress Website, stored within the Website database and transmitted to Ignis Rose Care's designated business email account. Website hosting, business email, security and related technology providers may therefore process consumer health data on behalf of Ignis Rose Care where such data is included in a Website submission. Where a service provider acts as a processor of consumer health data on behalf of Ignis Rose Care, Ignis Rose Care will maintain the contractual arrangements and safeguards required by applicable law.
- Categories of Consumer Health Data Shared: Ignis Rose Care does not currently share consumer health data with independent third parties for purposes that constitute “sharing” under MHMDA. Where those providers act as processors on behalf of Ignis Rose Care and process consumer health data consistently with the purpose for which the information was collected and the requirements of MHMDA, those disclosures are not treated as “sharing” with an independent third party for purposes of this Section. If Ignis Rose Care begins sharing consumer health data with independent third parties in circumstances constituting “sharing” under MHMDA, this Consumer Health Data Privacy Policy will be updated to identify the categories of consumer health data shared and the relevant categories of third parties before or when such sharing begins, and any consent required by applicable law will be obtained.
- Categories of Third Parties and Affiliates: Ignis Rose Care does not currently share consumer health data with independent third parties or affiliates for purposes constituting “sharing” under MHMDA. Ignis Rose Care does not currently have any affiliates with which it shares consumer health data. Ignis Rose Care uses service providers that may process consumer health data on its behalf in connection with the operation and administration of the Website and related services. These may include providers supporting Website hosting and database storage, Website form processing through Forminator, business email, communications, security and related technology functions. These service providers process information on behalf of Ignis Rose Care for the purposes of providing the relevant services and are treated as processors rather than independent third parties to the extent the requirements of MHMDA are satisfied. If Ignis Rose Care begins sharing consumer health data with an independent third party or affiliate in circumstances constituting “sharing” under MHMDA, this Section will be updated to identify the applicable category of third party and any specific affiliate required to be disclosed under applicable law.
- Consent to Collection and Sharing: Where MHMDA requires consent to collect consumer health data, Ignis Rose Care will obtain the required affirmative consent before the relevant collection occurs, unless the processing is otherwise permitted without separate consent, including where the processing is necessary to provide a product or service requested by the consumer. Where separate consent is required for sharing consumer health data, that consent will be obtained separately from any collection consent and before the relevant sharing occurs. Any consent required under MHMDA may be presented through a separate consumer health data consent at the appropriate point in the Website, enquiry, referral, assessment or onboarding process. Acceptance of this Privacy Policy or the Website Terms and Conditions does not constitute consent where MHMDA requires a separate affirmative act.
- Sale of Consumer Health Data: Ignis Rose Care does not sell consumer health data. Where applicable, any future sale of consumer health data would be undertaken only in accordance with the separate authorization and other requirements imposed by MHMDA.
- Advertising and Geofencing: Ignis Rose Care does not currently use consumer health data collected through the Website for unrelated targeted or behavioral advertising and does not currently use Meta/Facebook Pixel or another identified advertising pixel for that purpose. Ignis Rose Care does not use geofencing to identify or track clients or other consumers seeking healthcare services, collect consumer health data from consumers through geofencing, or send health-related notifications, messages or advertisements to consumers based on their location. Ignis Rose Care may separately use location-based or geofencing functionality in connection with caregiver workforce administration, including verification of caregiver clock-in and clock-out at assigned service locations. Such workforce functionality is used for caregiver timekeeping and attendance purposes and is not intended to track clients or their healthcare activities.
- Consumer Rights: Where MHMDA applies, consumers may have the right to confirm whether Ignis Rose Care is collecting, sharing or selling their consumer health data; access that data; obtain information concerning applicable third parties and affiliates with whom it has been shared or sold; withdraw consent to future collection or sharing where processing is based on consent; and request deletion of consumer health data. Where a valid deletion request applies, Ignis Rose Care will address deletion across systems and records subject to MHMDA and will notify applicable processors, contractors, affiliates or other recipients as required by law. Deletion from archived or backup systems may be completed within the additional period permitted by MHMDA.
- Exercising Consumer Rights: Consumers may exercise applicable MHMDA rights, including withdrawing consent to future collection or sharing where applicable, by emailing support@ignisrosecarellc.com or using any other privacy contact method identified in this Privacy Policy. Ignis Rose Care may use commercially reasonable measures to authenticate the identity of the consumer or the authority of an authorized representative. Where additional information is reasonably necessary for authentication, Ignis Rose Care may request that information before completing the request. Ignis Rose Care will not require a consumer to create a new account solely to exercise a right under MHMDA.
- Response Period and Fees: Ignis Rose Care will respond to an authenticated MHMDA request without undue delay and within the period required by applicable law. The ordinary response period is 45 days and may be extended once by an additional 45 days where permitted, provided that the consumer is informed of the extension within the initial response period. Requests will be handled without charge to the extent required by MHMDA. Manifestly unfounded, excessive or repetitive requests may be handled as permitted by applicable law.
- Appeals: Where Ignis Rose Care declines to take action on an MHMDA request, the consumer may appeal the decision using the privacy contact method provided in this Privacy Policy. Ignis Rose Care will respond to an appeal within the period required by applicable law and, where an appeal is denied, will provide information concerning how the consumer may submit a complaint to the Washington State Attorney General as required by MHMDA.
- Security and Non-Discrimination: Ignis Rose Care will restrict access to consumer health data to personnel, processors and contractors whose access is necessary for an authorized purpose and will maintain safeguards appropriate to the nature and sensitivity of the information. Ignis Rose Care will not unlawfully discriminate against a consumer for exercising a right provided under MHMDA.
22. Sale of Personal Information and Advertising Practices
- Sale of Personal Information: Ignis Rose Care does not sell personal information collected through the Website and does not receive monetary or other valuable consideration in exchange for that information.
- Sale of Consumer Health Data: Ignis Rose Care does not sell consumer health data and does not receive monetary or other valuable consideration in exchange for consumer health data. Any disclosure of consumer health data will be handled in accordance with the Washington My Health My Data Act and the consumer health data provisions of this Privacy Policy.
- Advertising and Tracking Practices: Ignis Rose Care does not currently use personal information or consumer health data collected through the Website for targeted or behavioral advertising based on an individual’s health status, care needs, referral activity, assessment requests or other health-related characteristics. Ignis Rose Care does not currently use Meta/Facebook Pixel or another identified advertising-tracking technology for those purposes.
- Disclosures to Service Providers: Ignis Rose Care may disclose personal information to service providers that support functions such as Website hosting, form processing, data storage, communications, security and other operational activities. Such disclosures are made for the purpose of obtaining services on behalf of Ignis Rose Care and are not treated as sales where the relevant disclosure does not constitute a sale under applicable law.
- Changes to Sale or Advertising Practices: If Ignis Rose Care changes its practices in a manner that would involve the sale of personal information or consumer health data, or introduces targeted or behavioral advertising technologies that materially affect the processing of personal information, Ignis Rose Care will update this Privacy Policy and provide any notice, consent or authorization required by applicable law before the relevant processing begins.
23. Data Retention
- General Retention Principles Ignis Rose Care retains personal information only for as long as reasonably necessary for the purpose for which it was collected or subsequently lawfully processed, subject to any longer period required or permitted by applicable legal, regulatory, licensing, contractual, recordkeeping or dispute-resolution requirements. Retention periods differ according to the nature of the information and the purpose for which it is maintained. Where information falls within more than one category, Ignis Rose Care may apply the longer applicable retention period where reasonably necessary or required by law.
- Preliminary Enquiries: Personal information collected solely in connection with a general or prospective-client enquiry that does not progress to an assessment, formal intake or provision of services will ordinarily be retained for up to 12 months after the enquiry is closed or the last substantive communication, unless a longer period is reasonably necessary for follow-up, legal, regulatory or recordkeeping purposes.
- Referrals That Do Not Progress: Where a referral does not progress to an assessment, intake or provision of services, the referral information will ordinarily be retained for up to 12 months after the referral is closed or the last substantive communication. If the referral progresses and the information becomes part of an assessment, intake or client record, the information will thereafter be retained in accordance with the retention period applicable to that record.
- Assessment Requests: Information collected in connection with an initial or free assessment request that does not result in the establishment of a client relationship will ordinarily be retained for up to 12 months after the assessment process is concluded or the last substantive communication. Where the assessment results in the provision of services, information incorporated into the client or care record will be retained in accordance with the requirements applicable to client records.
- Client and Care Records: Where Website information becomes part of a formal client or care record, the applicable client-record retention requirements will apply. For adult clients, Ignis Rose Care will retain client records for at least three years following termination of services, as required by applicable Washington home-care regulations. Where services are provided to a minor, or where a client dies while receiving services, the applicable longer statutory retention period will apply. A longer retention period may also apply where required by contract, law, regulation or another applicable recordkeeping obligation.
- Employment Applicants: Information relating to an applicant who is not employed by Ignis Rose Care will ordinarily be retained for up to two years following completion of the recruitment process, unless a longer period is required or reasonably necessary to comply with applicable employment, background-screening, regulatory or legal requirements. Where an applicant becomes an employee, relevant recruitment and onboarding information may become part of the employee’s personnel record and will thereafter be retained in accordance with the retention period applicable to employee records.
- Employee Records: Personnel, payroll, credentialing, training, employment eligibility and other employment-related records will be retained for the periods required by applicable federal and Washington employment, tax, wage, licensing and recordkeeping laws and, where appropriate, for a reasonable period following termination of employment. Ignis Rose Care may maintain different retention periods for different categories of employee records where the applicable legal requirements differ.
- Communication Consent and Opt-Out Records: Records documenting consent to receive email or text communications, communication preferences, withdrawals of consent, unsubscribe requests and opt-outs may be retained for as long as reasonably necessary to administer the individual’s preferences and demonstrate compliance with applicable communication and marketing requirements. Where an individual withdraws consent or opts out of communications, Ignis Rose Care may retain a limited suppression record for as long as reasonably necessary to ensure that the individual’s preference continues to be respected.
- Testimonial and Review Authorizations: Records relating to testimonial, review, media or similar authorizations may be retained for the period during which the relevant material remains in use and for a reasonable period thereafter to document the basis on which the material was published and to address any withdrawal, dispute or legal requirement relating to its use.
- Technical and Security Records: Technical logs, access records, security records and information generated for Website administration, fraud prevention or security purposes will be retained only for as long as reasonably necessary for the relevant operational or security purpose, including investigating incidents, preventing misuse and satisfying applicable legal or regulatory obligations. The applicable period may vary according to the type of log or security record and the systems through which it is generated.
- Website Form Submissions: Information retained within the Website database following submission of a Website form will be retained in accordance with the retention period applicable to the underlying information under this Section. Ignis Rose Care will periodically delete, transfer or otherwise securely dispose of Website submissions once the applicable retention period has expired and continued retention is not otherwise required or permitted.
- Document Acceptance and Acknowledgement Records: Records maintained to evidence acceptance of Website Terms, acknowledgement or provision of a legal or privacy notice, or another legally significant Website interaction may be retained for as long as reasonably necessary to demonstrate the relevant interaction, comply with applicable legal or regulatory requirements and establish, exercise or defend legal rights.
- Legal Holds and Extended Retention: Notwithstanding the ordinary retention periods described above, Ignis Rose Care may retain information for a longer period where reasonably necessary or required to comply with applicable law, regulation, licensing requirements, contractual obligations, legal process or a regulatory investigation; preserve evidence; investigate suspected misconduct or a security incident; resolve a dispute; or establish, exercise or defend legal rights or claims. Where such a reason for extended retention no longer applies, the information will be returned to the applicable retention schedule and deleted or otherwise securely disposed of when continued retention is no longer required.
- Deletion and Secure Disposal: At the end of the applicable retention period, personal information will be deleted, securely destroyed, de-identified or otherwise disposed of in a manner appropriate to the nature and sensitivity of the information, unless continued retention is required or permitted by applicable law. Deletion from active systems may not result in immediate removal from routine backup or disaster-recovery systems. Any residual copies will remain subject to appropriate safeguards and will be deleted or overwritten in accordance with the applicable backup cycle and legal requirements.
24. Information Security
- Security Measures: Ignis Rose Care maintains reasonable administrative, technical and organizational safeguards designed to protect personal information against unauthorized access, acquisition, disclosure, alteration, loss, misuse or destruction. The safeguards applied will depend on the nature, sensitivity and volume of the information processed and the systems through which it is handled. Website communications are transmitted using HTTPS/SSL technology, and access to systems containing information submitted through the Website is intended to be limited to personnel and other authorized persons who require access for legitimate business, administrative, recruitment or service-related purposes.
- Access Controls: Ignis Rose Care seeks to limit access to personal information according to the functions and responsibilities of the persons requiring access. Where information includes health-related information, consumer health data or other sensitive information, additional restrictions may apply depending on the nature of the information and the legal requirements governing it. Where consumer health data subject to the Washington My Health My Data Act is involved, access will be restricted in accordance with the requirements applicable to that information. Access to form submissions and other personal information stored within the Website administration environment is restricted to authorized users with appropriate credentials.
- Service Provider Security: Ignis Rose Care uses third-party technology providers to support functions including Website hosting, form processing, information storage and communications. Where such providers process personal information on behalf of Ignis Rose Care, Ignis Rose Care seeks to use providers and contractual arrangements appropriate to the nature of the services and information involved. Service providers may maintain their own administrative, technical and physical safeguards in accordance with their applicable contractual obligations and security practices.
- Electronic Communications: No Website, Internet transmission, email system, cloud-storage environment or other electronic method of processing can be guaranteed to be completely secure. Users should therefore avoid submitting unnecessary sensitive information through general Website forms or ordinary email and should follow any instructions provided by Ignis Rose Care concerning the appropriate method for transmitting detailed medical, financial, identification or other highly sensitive information.
- Security Incidents: Where Ignis Rose Care becomes aware of an actual or suspected privacy or information-security incident involving personal information, it will take reasonable steps to assess and investigate the incident, contain or mitigate potential harm, preserve relevant evidence and implement appropriate remedial measures. Where notification to affected individuals, regulators, law-enforcement authorities or other parties is required by applicable law, Ignis Rose Care will provide such notification in accordance with the applicable legal requirements.
25. Location of Processing
- Processing Locations: Ignis Rose Care operates in the United States. Personal information collected through the Website may be processed, transmitted or stored using the Website hosting environment, WordPress database, Ignis Rose Care’s business email systems and other service providers used to support its operations. Those providers may maintain or operate infrastructure in the United States or other geographic locations. Accordingly, personal information processed through their services may not necessarily be stored or processed exclusively within Washington State.
- No Commitment to Exclusive Geographic Storage: Unless expressly stated otherwise, Ignis Rose Care does not represent that all personal information collected through the Website will be stored exclusively in Washington State, exclusively within the United States or within any particular data center or geographic location. The location in which a service provider processes information may depend on the provider’s infrastructure, configuration, service architecture, backup arrangements and other technical factors.
- Protection of Information Processed in Other Locations: Where personal information is processed or stored outside Washington State or in another jurisdiction, Ignis Rose Care will continue to apply the privacy, confidentiality and security requirements that are applicable to its own processing of that information. Where the location of processing gives rise to additional legal, contractual or security obligations in relation to protected information, Ignis Rose Care will address those requirements as appropriate to the relevant processing activity.
26. Children's Privacy
- Website Not Directed to Children: The Website and the services promoted through it are not directed to children or minors, and Ignis Rose Care does not knowingly solicit personal information directly from children through the Website. Website forms and related functions are intended for adults who are seeking information or services for themselves, arranging care for another person, making a referral, pursuing employment opportunities or otherwise interacting with Ignis Rose Care in an appropriate adult capacity.
- Information Submitted by a Minor: If Ignis Rose Care becomes aware that a minor has independently submitted personal information through the Website in circumstances where the collection is not appropriate or permitted, Ignis Rose Care may take reasonable steps to delete, restrict or otherwise appropriately address the information in accordance with applicable law. Where additional verification is reasonably necessary to determine the circumstances in which the information was submitted, Ignis Rose Care may make appropriate enquiries before taking further action.
- Information Provided by Adults on Behalf of Another Person: This Section does not prevent a parent, legal guardian, authorized representative, healthcare professional or other person who is lawfully permitted to act for another individual from providing information concerning that individual where appropriate. Any such information will be handled in accordance with the privacy, confidentiality and authorization requirements applicable to the information and circumstances involved.
27. Privacy Rights
- Rights Depend on Applicable Law: The privacy rights available to an individual may differ depending on the nature of the personal information involved, the circumstances in which it was collected, the individual’s relationship with Ignis Rose Care and the federal or Washington law governing the information. Accordingly, not every right described in this Privacy Policy will apply to every individual or every category of personal information.
- General Privacy Rights Depending on the applicable law and circumstances, an individual may have rights to request access to personal information maintained about them, request correction or amendment of inaccurate information, request deletion of certain information, withdraw consent where processing is based on consent, obtain information concerning certain uses or disclosures, or exercise other rights provided by applicable law. Any such right may be subject to applicable conditions, limitations, verification requirements, exemptions or record-retention obligations.
- Consumer Health Data Rights: Consumers whose information is subject to the Washington My Health My Data Act have the rights described in Section 21 of this Privacy Policy, including applicable rights concerning access, deletion, withdrawal of consent and information concerning certain sharing of consumer health data. Requests relating specifically to consumer health data will be handled in accordance with the procedures and timeframes applicable under that Section.
- Washington Health Care Information Rights: Where personal information constitutes health care information subject to Chapter 70.02 RCW or another applicable Washington health-information law, the individual may have separate rights concerning access to, inspection of, copying of or amendment of health care records, as well as rights or protections concerning particular disclosures. Those rights will be administered in accordance with the legal requirements applicable to the relevant health care information.
- HIPAA Rights: Where HIPAA applies to Ignis Rose Care and to the relevant protected health information, individuals may have additional rights under HIPAA. Where Ignis Rose Care is required to provide a HIPAA Notice of Privacy Practices, the applicable notice will describe those rights and the procedures for exercising them.
- Employment and Applicant Information: Information processed in connection with employment or recruitment may be subject to privacy, access, retention and other requirements that differ from those applicable to prospective-client or health-related information. Any rights concerning applicant or employment information will therefore be determined by the law applicable to that information and the circumstances in which it is maintained.
28. Submitting a Privacy Request
- How to Submit a Request: General privacy requests may be submitted to Ignis Rose Care using the contact details in this Policy. A request should describe the personal information or privacy right concerned with sufficient detail to allow Ignis Rose Care reasonably to understand, locate and respond to the request. Individuals should avoid including unnecessary medical or other highly sensitive information in an initial privacy request unless that information is reasonably necessary to identify the relevant records or right.
- Identity Verification: Before providing access to personal information, deleting information, correcting records or taking other action in response to a privacy request, Ignis Rose Care may take reasonable steps to verify the identity of the requesting individual. The nature and extent of verification will depend on the sensitivity of the information involved, the nature of the request and the risk associated with unauthorized disclosure or action. Ignis Rose Care will seek to limit verification information to what is reasonably necessary for the relevant request.
- Requests Made on Behalf of Another Individual: Where another person submits a privacy request on behalf of an individual, Ignis Rose Care may require reasonable evidence establishing that person’s identity and authority to act. Depending on the circumstances, Ignis Rose Care may also communicate directly with the individual concerned where appropriate to confirm the representative’s authority or the scope of the request.
- Requests That Cannot Be Verified or Fulfilled: Where Ignis Rose Care cannot reasonably verify the identity or authority of the requesting person, it may be unable to complete the request and will provide any explanation required by applicable law. A request may also be limited, delayed or denied where applicable law permits or requires Ignis Rose Care to retain information, restricts the exercise of a particular right, protects the rights of another person, or otherwise provides an applicable exception.
- Applicable Procedures and Timeframes: Privacy requests will be handled in accordance with the procedures, response periods and other requirements applicable under the law governing the particular information. Where a specific statutory regime, including MHMDA, HIPAA or Washington health-information law, establishes a different procedure or timeframe, that procedure or timeframe will apply to the relevant request.
29. Authorized Representatives
- Requests Through an Authorized Representative Where applicable law permits an authorized representative to exercise privacy rights on behalf of another individual, Ignis Rose Care may accept a request submitted by that representative subject to appropriate verification of the representative’s identity and authority.
- Verification of Authority Depending on the nature of the request and the information involved, Ignis Rose Care may require written authorization, a power of attorney, guardianship documentation, other legal documentation, or another form of evidence reasonably sufficient to establish the representative’s authority. Ignis Rose Care may also communicate directly with the individual concerned where reasonably necessary and legally permitted to confirm the authorization or clarify the scope of the representative’s authority.
- Scope of Authority: Authority to act for an individual in one context does not necessarily establish authority to exercise all privacy, healthcare, contractual or other legal rights on that individual’s behalf. In particular, the fact that a person has submitted a referral, made an enquiry, arranged an assessment or otherwise communicated with Ignis Rose Care concerning another person does not, by itself, establish that the person is authorized to exercise that individual’s privacy rights or obtain confidential information concerning them.
30. Third-Party Websites and Services
- Links and Third-Party Services: The Website may contain links to, embed content from or otherwise facilitate interaction with websites, platforms or services operated independently by third parties. These may include social-media platforms, video-hosting services, scheduling services, communication platforms and other external online services.
- Independent Privacy Practices: When a user follows a link to, accesses embedded content from or otherwise interacts directly with an independent third-party service, that third party may collect, use, store or disclose information in accordance with its own privacy policy, terms of use, cookie practices and other applicable notices. This Privacy Policy governs Ignis Rose Care’s handling of personal information and does not govern the independent privacy practices of a third party acting for its own purposes.
- Information Shared With Third-Party Providers: Where Ignis Rose Care intentionally uses a third-party service as a provider acting on its behalf, any personal information disclosed to that provider will be handled in accordance with the provisions of this Privacy Policy applicable to service providers and any additional legal requirements governing the relevant information. This is distinct from circumstances in which a user independently leaves the Website or interacts directly with a third-party platform.
- User Responsibility When Accessing External Services: Users should review the privacy notices and other applicable terms of any third-party website or service before providing personal information directly to that provider. Ignis Rose Care is not responsible for the independent collection, use or disclosure of personal information by third parties except to the extent responsibility is imposed on Ignis Rose Care by applicable law in connection with its own selection, integration or use of the relevant service.
31. Changes to the Privacy Policy
- Updates to this Privacy Policy: Ignis Rose Care may update this Privacy Policy from time to time to reflect changes in the Website, its forms or functionality, the categories of information collected, service providers, information-processing practices, security measures, business operations, or applicable legal and regulatory requirements. The most current version of this Privacy Policy will be made available through the Website and will identify the applicable effective date or last-updated date.
- Material Changes: Where a change materially affects the manner in which personal information is collected, used, disclosed or otherwise processed, Ignis Rose Care will provide any additional notice required by applicable law. Where applicable law requires affirmative consent, authorization or another specific action before a new or materially different processing activity may begin, Ignis Rose Care will obtain that consent or authorization before undertaking the relevant processing.
- Changes Affecting Consumer Health Data: Where the Washington My Health My Data Act applies, Ignis Rose Care will comply with any additional notice and consent requirements applicable to changes in its consumer health data practices. In particular, where applicable law requires affirmative consent before Ignis Rose Care may collect additional categories of consumer health data, use consumer health data for an additional purpose or share consumer health data in a manner not previously authorized, publication of an amended Privacy Policy or continued use of the Website will not, by itself, be treated as a substitute for the required affirmative consent.
32. Related Privacy and Service Documentation
- Additional Documentation: Depending on the nature of an individual’s interaction with Ignis Rose Care, additional privacy, consent, authorization, service, employment or other documentation may apply to particular information or activities. Such documentation may include the Website Terms and Conditions, this Privacy Policy and the consumer health data provisions contained within it, any applicable HIPAA Notice of Privacy Practices, health-information consents or authorizations, client intake and service documentation, care-related records, referral or assessment documentation, testimonial or media release authorizations, employment or background-screening notices, and any cookie, analytics or technology notices introduced from time to time. The Website Terms and Conditions will be made available through the Website at the applicable legal or terms page.
- Relationship Between Documents: This Privacy Policy should be read together with any additional notice, consent, authorization or agreement provided in connection with a particular interaction or category of information. Where a separate document applies specifically to a particular type of information or processing activity, that document will govern the relevant activity to the extent required by applicable law. For example, where protected health information is subject to an applicable HIPAA Notice of Privacy Practices, or where a separate authorization is required for a particular use or disclosure of health information, the applicable notice or authorization will govern that processing. Nothing in this Privacy Policy is intended to replace a separate notice, consent or authorization where one is required by law.
