Terms and Conditions
Effective Date: 10/14/2026
Last Updated: 10/14/2026
These Website Terms and Conditions (the “Terms”) govern access to and use of www.ignisrosecarellc.com and the webpages, forms, features, information, content and functionality made available through that website (collectively, the “Website”). The Website is owned and operated by Ignis Rose Care LLC, a Washington limited liability company (“Ignis Rose Care,” “IRC,” “we,” “our,” or “us”). Please read these Terms carefully. By clicking “Accept”, ticking an unchecked box confirming your agreement to these Terms, or otherwise affirmatively indicating your acceptance before submitting information through a Website form, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree with these Terms, you should not submit the relevant form or otherwise use any Website functionality for which acceptance of these Terms is required.
IMPORTANT: These Terms govern use of the Website. They do not themselves create a client-care relationship, constitute a care plan or service agreement, or guarantee that Ignis Rose Care will provide services to any individual.
1. About Ignis Rose Care
- Ignis Rose Care LLC is a Washington-based home-care provider offering in-home assistance and support services to individuals who require help with day-to-day activities while remaining in their own homes or other appropriate residential settings. Our services are intended to support clients with their personal care, daily living activities, household needs, mobility, companionship and other nonmedical aspects of everyday life.
- The nature and extent of the services provided to each client will depend on that individual's assessed needs, the agreed plan of care, the availability and qualifications of appropriate personnel, the terms of the applicable service agreement and any requirements imposed by applicable law. Services may include assistance with bathing, drying and dressing; toileting and incontinence care; mobility, transferring and positioning; meal preparation and feeding assistance; homemaking and household tasks such as cleaning, vacuuming, dusting, sweeping and mopping; shopping and errands; transportation to appointments, errands or other appropriate activities; companionship and social or emotional support; medication reminders; and observing and communicating relevant changes in a client's condition, well-being or care needs to appropriate members of the client's care team or other authorized persons. Ignis Rose Care may also provide other home-care services that fall within the lawful scope of its operations and are agreed as part of the applicable care arrangements.
- Any description of services on the Website is intended to provide a general overview of the types of support that Ignis Rose Care may be able to offer. It does not mean that every service is available to every individual, nor does it create an obligation to provide any particular service. The specific services to be provided to a client will be determined separately following the appropriate assessment and intake process and will be documented in the relevant plan of care, service agreement or other applicable client documentation.
- Ignis Rose Care provides its services only within the scope permitted by applicable Washington law, its licensing and regulatory requirements, and the qualifications and authority of the personnel providing the relevant services. Unless expressly agreed and lawfully provided by appropriately qualified personnel, the services described on the Website should not be understood as including skilled nursing, medical diagnosis, medical treatment, psychotherapy or any other service that may only be provided by a separately licensed healthcare professional. Nothing on the Website is intended to enlarge the scope of services that Ignis Rose Care, or any caregiver acting on its behalf, is legally authorized or qualified to provide.
2. Purpose of the Website
- The Website is intended primarily as an informational and administrative resource for individuals and organizations wishing to learn more about Ignis Rose Care and its services, make an initial enquiry, request an assessment, submit a referral, express interest in employment opportunities or access general educational and informational content.
- Through the Website, prospective clients, family members, friends, responsible parties and authorized representatives may contact Ignis Rose Care regarding potential care needs. Healthcare providers, senior-care organizations and other referral sources may also use the Website to submit preliminary referral information for consideration. In addition, prospective employees and caregivers may use the Website to express interest in working with Ignis Rose Care.
- The Website may also include articles, blogs, videos and other educational or informational materials, allow users to indicate communication preferences, and provide scheduling or other administrative functionality where such features are made available.
- The Website is not itself a platform through which home-care services are provided. Any enquiry, assessment request, referral, employment expression of interest or other communication submitted through the Website is preliminary in nature and does not replace the assessment, intake, care-planning, onboarding or contracting processes that may apply to a prospective client, applicant or other user. Home-care services will only be provided after Ignis Rose Care has completed the appropriate assessment and intake process and the relevant service documentation has been agreed or completed.
3. Eligibility and Authority
- The Website is intended for use by adults who are capable of providing information and making requests in connection with the services and opportunities described on the Website. You must be at least 18 years old to submit an enquiry, request an assessment, make or facilitate a referral, express interest in employment or otherwise provide personal information through the Website.
- Certain Website functions permit users to provide information concerning another individual, including a prospective client who may be seeking or considering home-care services. This may occur, for example, where the person completing the relevant form is a family member, friend, responsible party, authorized representative, legal representative, healthcare professional, representative of a healthcare, senior-care or community organization, or another person who is appropriately involved in arranging, coordinating or facilitating care for that individual.
- Where you submit information concerning another person, you are responsible for ensuring that you are entitled to provide that information to Ignis Rose Care for the purpose for which it is submitted. Depending on the circumstances, this may require that the individual concerned is aware of the referral or enquiry, has authorized you to provide the information or to request that Ignis Rose Care contact them, or that you otherwise have an appropriate lawful basis or authority to act on their behalf. Where the Website asks you to identify your relationship to the individual concerned or to confirm that the individual or their authorized representative is aware of the referral or has authorized contact by Ignis Rose Care, you must provide complete and accurate information.
- You must not represent that you are an authorized representative, legal representative, healthcare provider, responsible party or other person with authority to act for an individual unless that representation is accurate. In particular, submission of information through the Website does not itself establish that you have authority to make healthcare, financial, contractual or other decisions on behalf of the individual concerned.
- Ignis Rose Care may, where reasonably necessary, request further information or documentation to verify a person's identity, relationship to the prospective client or authority to act before relying on information submitted through the Website, discussing confidential matters, commencing an assessment or taking any other substantive step in connection with a referral or enquiry. Ignis Rose Care may also contact the prospective client or another appropriate representative directly where this is necessary to confirm the referral, establish authority or obtain information required for the assessment or intake process.
- The fact that Ignis Rose Care receives or reviews information submitted by a third party does not mean that Ignis Rose Care has accepted the third party's asserted authority, confirmed the accuracy of the information provided or agreed to act on any request contained in the submission. Any decision to proceed with an assessment, intake or other step will remain subject to Ignis Rose Care's own verification, assessment and applicable legal and regulatory requirements.
- Users should provide only information that is reasonably necessary for the relevant enquiry, referral or request and should avoid submitting confidential, medical or other sensitive information concerning another person unless that information is appropriate for the particular Website form and they are entitled to provide it. More detailed health, medical or care-related information may be collected separately during the appropriate assessment or intake process.
- Nothing in this Section transfers to the user, or limits in any way, any independent obligation of Ignis Rose Care under applicable privacy, confidentiality, health-information, recordkeeping or other laws. Ignis Rose Care remains responsible for complying with its own legal obligations in relation to personal information that it receives, including any obligation to verify authority, limit disclosure, protect confidential information or obtain additional consent or authorization where required.
4. No Client Care Relationship Through Website Use
- The Website is intended to facilitate preliminary enquiries, referrals, assessment requests, scheduling and other administrative communications with Ignis Rose Care. Accessing the Website or communicating with Ignis Rose Care through it does not, by itself, establish a client-care relationship or create any obligation on Ignis Rose Care to provide home-care services.
- In particular, submitting a contact form, requesting an assessment, making or facilitating a referral, scheduling an introductory call or meeting, or otherwise providing information through the Website does not constitute acceptance of any individual as an Ignis Rose Care client, does not create a caregiver-client, fiduciary or other professional relationship, and does not amount to an agreement by Ignis Rose Care to provide any particular service. It also does not constitute or replace a plan of care, reserve a caregiver or service slot, guarantee the availability of any service or caregiver, guarantee that services will commence on a requested date, establish eligibility for insurance coverage, public benefits, veterans' benefits or any other payment or reimbursement arrangement, or guarantee any particular care outcome.
- Any information submitted through the Website will be treated as preliminary information for review and follow-up. Before Ignis Rose Care agrees to provide services, it may need to communicate further with the prospective client, responsible party, authorized representative or referral source; conduct an assessment; obtain additional information regarding the individual's needs and circumstances; determine whether the requested services fall within the scope of services that Ignis Rose Care is lawfully and appropriately able to provide; assess staffing, scheduling and geographic availability; consider any relevant safety, suitability or care-delivery requirements; confirm applicable payment arrangements; and complete the documentation necessary to commence services.
- Where appropriate, the assessment and intake process may also involve the preparation, review or approval of a written plan of care and the completion of applicable client service documentation, consents, authorizations, privacy notices and other records required by Ignis Rose Care or applicable law. The fact that Ignis Rose Care receives, acknowledges, reviews or responds to an enquiry or referral does not mean that the prospective client has been accepted for services.
- Ignis Rose Care reserves the right, subject to applicable law, to determine whether it is able to accept a prospective client or provide the services requested. This may include declining or referring a request elsewhere where Ignis Rose Care reasonably determines that the individual's needs fall outside the scope of the services it provides, appropriate personnel are unavailable, the requested service cannot be provided safely or lawfully, required arrangements cannot be put in place, or Ignis Rose Care is otherwise unable to meet the individual's needs appropriately.
- If Ignis Rose Care agrees to provide home-care services, the resulting service relationship will be governed by separate client documentation. Depending on the circumstances, that documentation may include a client service agreement, an assessment, a written plan of care, applicable rates and payment terms, service schedules, client-rights documentation, consents and authorizations, privacy or health-information notices, and any other documentation required for the relevant services.
- These Website Terms are separate from those service-specific arrangements. If there is any inconsistency between these Terms and an executed client service agreement, an approved plan of care or another service-specific document, the service-specific document will govern to the extent of that inconsistency in relation to the provision of home-care services. These Terms will continue to govern access to and use of the Website.
5. Information Provided Through the Website
- All content made available through the Website is provided for general informational purposes only. Unless expressly confirmed otherwise in a separate communication from Ignis Rose Care, Website content is not tailored to the individual circumstances, care needs or requirements of any particular prospective or existing client and should not be relied upon as a substitute for an assessment or other individualized review.
- The Website does not provide medical advice, diagnosis or treatment. Information made available through the Website should not be relied upon for decisions concerning any medical condition, diagnosis, treatment, medication, symptoms, deterioration in health, medical equipment or other matter requiring the judgment of a physician, nurse or other appropriately qualified healthcare professional. Where medical advice or treatment is required, advice should be obtained from an appropriately qualified healthcare professional.
- Any information concerning home-care services, care needs or available support is intended to describe the nature of the services that Ignis Rose Care may be able to provide and does not constitute a clinical assessment, medical recommendation or determination that any particular service is appropriate for an individual.
- The Website also does not provide legal, tax, financial, insurance or benefits advice. Any references to long-term care insurance, veterans' benefits or other public or private funding or reimbursement arrangements are provided for general informational purposes only and do not constitute confirmation of eligibility, coverage, entitlement, reimbursement or payment. Any such matters remain subject to the requirements, decisions and processes of the relevant insurer, government agency, benefits administrator or other responsible third party.
6. Emergencies and Urgent Situations
- The Website and any communications made through it are not intended for emergency use and should not be relied upon as a means of obtaining urgent medical, safety or emergency assistance. Contact forms, assessment-request forms, referral forms, email, text messaging, online scheduling tools and other Website-based communications may not be monitored continuously and submissions may not be reviewed or responded to immediately.
- If an individual is experiencing a medical emergency, an immediate threat to health or safety, or any other situation requiring urgent assistance, the appropriate emergency services should be contacted without delay, including by calling 911 where appropriate. A user should not wait for, or rely upon, a response from Ignis Rose Care before seeking emergency assistance.
- Where a Website form permits a referral or request to be identified as “urgent,” “immediate” or by reference to another priority level, that designation is provided solely to indicate the requested timing of the referral or assessment. It does not create an emergency-response obligation, guarantee immediate review or contact, or constitute a commitment by Ignis Rose Care to provide an assessment, caregiver or other service within any particular timeframe.
7. General Contact and Enquiries
- The Website may provide general contact and enquiry forms through which users can submit information to Ignis Rose Care. Depending on the relevant form, the information requested may include the user's name, email address, telephone number, relationship to a person seeking care, the nature of the enquiry or message, and any stated communication preferences.
- Any information submitted through a general Website form should be limited to what is reasonably necessary to enable Ignis Rose Care to understand and respond to the relevant enquiry. Where a form includes a free-text field, users should exercise appropriate care when deciding what information to include and should avoid providing sensitive or confidential information that is not necessary at the preliminary enquiry stage.
- Unless expressly requested by Ignis Rose Care through an appropriate and secure method, users should not submit Social Security numbers, bank account details, payment-card information, passwords or authentication credentials, copies of passports, driver's licenses or other identification documents, detailed insurance policy or member identification numbers, complete medical records, extensive diagnostic or treatment information, or other highly sensitive information through a general Website contact form.
- Where additional personal, financial, health-related or other sensitive information is required for assessment, intake, onboarding or the provision of services, Ignis Rose Care may request that such information be provided separately through an appropriate process. The availability of a free-text field or general contact form does not mean that all categories of personal or sensitive information are required or appropriate for submission through the Website.
8. Requesting a Free Assessment
- The Website may allow a prospective client, responsible party or other authorized person to request an initial free assessment in connection with potential home-care services. For this purpose, the Website may request basic information concerning the prospective client, including their name and contact details, location, a general description of care needs, preferred start date, desired care schedule and, where applicable, information concerning the responsible party or other person assisting with the request. The form may also allow the user to indicate relevant communication preferences.
- A request for a free assessment constitutes a preliminary expression of interest only. Submission of the form does not create a client-care relationship, constitute acceptance of the prospective client for services, reserve a caregiver or service slot, or amount to a commitment by Ignis Rose Care to provide any particular service, schedule or commencement date. Any request remains subject to further review, assessment, availability, suitability and completion of the applicable intake and service arrangements.
- Ignis Rose Care may contact the prospective client, responsible party or other appropriate representative following receipt of an assessment request in order to obtain further information, discuss the individual's circumstances and care requirements, and determine whether Ignis Rose Care may be able to provide appropriate services.
- The information requested through the Website at this stage is intended to be limited to preliminary information reasonably necessary to consider and respond to the assessment request. Where more detailed information concerning an individual’s medical conditions, diagnoses, medications, functional limitations, care history or other health-related matters is required, that information may be collected separately as part of the appropriate assessment or intake process and in accordance with applicable privacy and health-information requirements.
- The Website assessment form is not a substitute for a formal assessment or plan of care. Any determination regarding the nature, scope, frequency or suitability of services will be made only after Ignis Rose Care has completed the relevant assessment and intake process and, where services are accepted, documented the agreed arrangements in the applicable client and care documentation.
9. Referrals
- Ignis Rose Care may permit referrals to be submitted through the Website by prospective clients, family members, responsible parties, healthcare professionals, senior-care organizations, community organizations and other appropriate referral sources. The referral process is intended to provide Ignis Rose Care with sufficient preliminary information to consider the prospective client's needs and determine whether further assessment or intake may be appropriate.
- The referral form may request information concerning the prospective client, including basic identifying and contact information, date of birth where relevant, residential location, primary contact details, a general description of the reason for referral or services requested, preferred commencement date and the urgency of the referral. The form may also request limited information regarding the anticipated payment or coverage source, together with identifying and contact information for the referring provider, organization or individual.
- At the referral stage, Ignis Rose Care does not require detailed insurance policy information, member identification numbers or other extensive financial or coverage information unless this is specifically requested through an appropriate process. Any indication that services may be funded through private pay, long-term care insurance, a waiver program, veterans’ benefits or another source is preliminary only and does not constitute confirmation of eligibility, coverage, authorization, reimbursement or payment. Any such matters remain subject to separate verification and, where applicable, the requirements and determinations of the relevant insurer, government program, benefits administrator or other funding source.
- A person submitting a referral concerning another individual must be appropriately authorized, or otherwise lawfully permitted, to provide the relevant information to Ignis Rose Care for that purpose. Where the referral form requires confirmation that the prospective client or their authorized representative is aware of the referral, has consented to the referral, or has authorized Ignis Rose Care to make contact, the referring party must ensure that the confirmation provided is accurate.
- Where the required authority or permission has been provided, Ignis Rose Care may use the information submitted through the referral process to review the referral, contact the prospective client or an appropriate representative, discuss the individual's general care needs, conduct preliminary intake, arrange an assessment, determine whether the requested services fall within the scope of services Ignis Rose Care is able to provide, and undertake related care-coordination and administrative activities.
- Receipt, acknowledgement or review of a referral does not constitute acceptance of the prospective client for services and does not create a client-care relationship. Any decision to provide services remains subject to Ignis Rose Care's assessment and intake processes, applicable legal and regulatory requirements, staffing and service availability, suitability of the requested services and completion of the relevant client and care documentation..
10. Privacy and Health-Related Information
- Ignis Rose Care respects the privacy of individuals who use the Website and is committed to handling personal information in accordance with applicable privacy and health-information laws. The collection, use, disclosure, retention and protection of personal information obtained through the Website are described in greater detail in the Ignis Rose Care Privacy Policy and, where applicable, any additional privacy notice, consumer health data notice or other notice provided at or before the point at which information is collected. The Privacy Policy forms an important part of the information governing use of the Website and should be read together with these Terms. Where a separate consent, authorization or privacy notice is required by applicable law for a particular collection, use or disclosure of information, that requirement will be addressed separately and will not be treated as satisfied merely by acceptance of these Terms.
- The Website is intended principally to collect the information reasonably necessary to administer general enquiries, preliminary requests for assessments, referrals, employment enquiries, communication preferences and other administrative functions identified at the point of collection. The type and amount of information requested will depend on the relevant Website function. Ignis Rose Care seeks to limit the information collected through its public-facing Website forms to information reasonably appropriate to the particular purpose for which the form is provided. Additional information may be requested separately where it is required for an assessment, intake, employment onboarding, service delivery or another subsequent process.
- Certain Website forms may permit the submission of limited information concerning a prospective client's care needs, circumstances or other health-related matters. Such information is intended to assist Ignis Rose Care in understanding the nature of an enquiry or referral and determining whether further assessment or follow-up may be appropriate. The Website is not intended to serve as the primary means of collecting detailed medical or clinical information. Unless expressly requested by Ignis Rose Care through an appropriate process, users should not submit detailed diagnoses, medical histories, medication records, treatment records, complete medical records or other extensive health information through general Website forms. Where more detailed health, functional, medical or care-related information is required, Ignis Rose Care may request that information separately as part of the applicable assessment, intake or care-planning process and will handle it in accordance with applicable law and the relevant privacy documentation.
- Certain Website forms may contain free-text fields through which a user can choose what information to provide. Because Ignis Rose Care cannot control in advance the information that a user may voluntarily include in such a field, users should exercise appropriate care and provide only information that is reasonably necessary for the relevant enquiry, referral or request. The availability of a free-text field does not constitute a request for, or authorization to submit, every category of personal, confidential, medical or otherwise sensitive information. Information that is not reasonably necessary at the preliminary Website stage should instead be provided through the appropriate subsequent process where requested by Ignis Rose Care. Personal information, health-related information and other protected information received by Ignis Rose Care will be handled in accordance with the federal and Washington privacy, confidentiality and health-information laws applicable to the particular information and circumstances. Nothing in these Terms is intended to waive, limit, replace or modify any right or obligation arising under applicable privacy or health-information law. Where applicable law provides an individual with rights concerning access, correction, deletion, restriction, withdrawal of consent or other matters relating to personal or health information, those rights will be addressed in accordance with the applicable legal requirements and the relevant Ignis Rose Care privacy notice.
- To the extent that the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations (“HIPAA”) apply to Ignis Rose Care, a particular activity undertaken by Ignis Rose Care or particular information received or maintained by it, Ignis Rose Care will handle the relevant information in accordance with its applicable HIPAA obligations. The submission of information through the Website does not necessarily mean that such information constitutes “protected health information” within the meaning of HIPAA. The legal status and protection applicable to particular information will depend on the circumstances in which it is collected, maintained, used or disclosed and the laws applicable to that information. Nothing in these Terms is intended to characterize information as protected health information where it does not meet the applicable legal definition or otherwise to expand the scope of HIPAA beyond its lawful application. Acceptance of these Terms does not constitute an authorization under HIPAA for the use or disclosure of protected health information where a separate authorization is required by applicable law. Where Ignis Rose Care requires an individual's authorization for a particular use or disclosure of protected health information, any such authorization will be obtained separately and in the form required by applicable law. Acceptance of the Website Terms, submission of an enquiry or referral, or use of another Website function will not replace a separate authorization where one is legally required.
- Information provided through the Website may, depending on its nature and the circumstances in which it is collected, constitute or include “consumer health data” subject to applicable Washington law. Where such requirements apply, Ignis Rose Care will collect, use, disclose and otherwise process that information in accordance with the applicable legal requirements and any relevant consumer health data privacy notice. Where Washington law requires separate consent or authorization in connection with the collection, sharing, sale or other processing of consumer health data, that consent or authorization will be sought separately in the manner required by law. Acceptance of these Terms does not, by itself, constitute consent to any processing of consumer health data for which a separate affirmative consent or authorization is legally required. Nothing in these Terms constitutes an authorization for Ignis Rose Care to sell consumer health data.
- These Terms address the contractual conditions governing use of the Website and are not intended to operate as a comprehensive privacy notice. More detailed information regarding the categories of personal information collected through the Website, the purposes for which information is used, applicable disclosures to service providers or other third parties, retention practices, individual privacy rights and methods for exercising those rights is set out in the Ignis Rose Care Privacy Policy and any other privacy notice applicable to the relevant information or processing activity. If there is any inconsistency between this Section and a privacy notice that is required by applicable law to govern the collection or processing of particular information, the applicable privacy notice will govern that processing to the extent required by law.
11. Website Security and Electronic Transmission
- Ignis Rose Care maintains reasonable administrative, technical and organizational safeguards designed to protect information submitted through the Website against unauthorized access, use, alteration or disclosure, having regard to the nature of the Website, the information processed through it and the risks associated with electronic transmission and storage.
- Notwithstanding those safeguards, no method of transmitting information over the Internet, by email or through an online form, and no method of electronic storage, can be guaranteed to be completely secure or free from unauthorized interception, access, loss or misuse. Use of the Website and electronic communications is therefore subject to the inherent risks associated with Internet-based communications.
- Users should exercise appropriate care when deciding what information to submit electronically and should limit information provided through general Website forms to what is reasonably necessary for the relevant enquiry, referral or request. Highly sensitive information should not be transmitted through ordinary Website forms or standard email unless Ignis Rose Care has specifically requested that information and identified an appropriate method for providing it.
- Where Ignis Rose Care makes available, or directs a user to use, a designated secure method for transmitting sensitive, confidential, medical or other protected information, that method should be used in preference to ordinary email or general Website functionality. The availability of a general contact form or email address does not mean that such channels are appropriate for the transmission of all categories of personal or health-related information.
- Ignis Rose Care may implement, modify or replace security measures and technical safeguards from time to time in response to operational, technological, legal or regulatory requirements. Nothing in these Terms constitutes a warranty that the Website, any associated system or any electronic communication will be completely secure at all times.
- Nothing in this Section limits or excludes any obligation of Ignis Rose Care under applicable privacy, health-information, data-security or breach-notification laws. Where a privacy or security incident occurs and applicable law requires investigation, mitigation, notification or other remedial action, Ignis Rose Care will address the incident in accordance with the relevant legal requirements.
12. Employment and "Join Our Team" Enquiries
- The Website may include functionality through which individuals can express interest in employment or caregiving opportunities with Ignis Rose Care. Information requested at this preliminary stage may include the applicant’s name, telephone number, email address, residential address or location, relevant caregiving experience, the position or type of work in which the applicant is interested, preferred times for follow-up contact, and information about how the applicant became aware of Ignis Rose Care.
- Any information submitted through the Website for recruitment purposes constitutes a preliminary expression of interest only. Submission of an employment or “Join Our Team” enquiry does not constitute an offer of employment, create an employment or contractor relationship, guarantee an interview or further consideration, or oblige Ignis Rose Care to offer, create or maintain any particular position. Any recruitment decision will remain subject to Ignis Rose Care’s applicable hiring requirements, business needs and completion of the relevant recruitment and onboarding processes.
- Where an individual progresses beyond the preliminary enquiry stage, Ignis Rose Care may request additional information or documentation necessary to assess suitability for the relevant role and to satisfy applicable legal, regulatory or operational requirements. Depending on the position, this may include employment eligibility information, identity documentation, references, background-check information, evidence of qualifications, licenses, certifications, training records and other information lawfully required for recruitment or onboarding.
- Such information should not be submitted through general public Website forms unless Ignis Rose Care expressly requests that it be provided through that channel. Where more sensitive or detailed information is required, Ignis Rose Care may direct the applicant to provide it through a separate or more appropriate process.
- Information submitted for recruitment purposes will be handled in accordance with the applicable Ignis Rose Care Privacy Policy and any additional applicant privacy notice or disclosure provided in connection with the recruitment process.
- Nothing in these Terms limits or excludes any rights or protections available to applicants under applicable employment, anti-discrimination, disability, background-check, privacy or other laws, or any corresponding obligations of Ignis Rose Care in connection with recruitment and hiring.
13. Email and Text Communications
- Where a user provides an email address or telephone number in connection with an enquiry, assessment request, referral, employment enquiry or other request submitted through the Website, Ignis Rose Care may use those contact details to respond to the relevant request, provide information requested by the user and administer any related follow-up, assessment, referral, recruitment or service process, in each case subject to applicable law.
- The Website may also provide users with separate choices regarding whether they wish to receive promotional or marketing communications from Ignis Rose Care by email or text message. For these purposes, promotional or marketing communications are communications intended to advertise or promote Ignis Rose Care's services. They do not include ordinary service, operational or administrative communications, such as responding to an enquiry, requesting or confirming documentation, arranging or confirming an assessment or service start date, providing scheduling information, communicating regarding an application or referral, or providing updates reasonably connected with a client's care or requested services. Where consent is required by applicable law for promotional or marketing communications, Ignis Rose Care will seek that consent separately.
- Where a marketing communication preference is offered, the decision whether to opt in is voluntary. A refusal to consent to promotional emails or text messages will not, by itself, prevent a user from requesting information about Ignis Rose Care’s services, submitting a referral, requesting an assessment or otherwise using the Website. Consent to receive marketing communications is not a condition of obtaining home-care services except to the extent expressly permitted by applicable law.
- If a user elects to receive text messages from Ignis Rose Care, message frequency may vary depending on the nature of the communications and the user’s interaction with Ignis Rose Care. Message and data rates may apply. Users may reply STOP to opt out of text messages and HELP for assistance, or contact Ignis Rose Care at support@ignisrosecarellc.com. Opting out of promotional text messages will not prevent Ignis Rose Care from sending service-related or other non-promotional communications where permitted by applicable law.
- A user may withdraw or update an applicable marketing communication preference at any time by following the unsubscribe or opt-out instructions included in the relevant communication or by contacting Ignis Rose Care at support@ignisrosecarellc.com. Withdrawal from marketing communications does not constitute a request to stop service-related, operational or legally required communications.
- For the avoidance of doubt, withdrawal of consent to promotional or marketing communications does not prevent Ignis Rose Care from sending non-promotional communications where reasonably necessary to respond to an enquiry or request, administer a referral or assessment, communicate in relation to requested or existing services, address operational, safety or administrative matters, or comply with applicable legal or regulatory obligations.
14. Online Scheduling and Video Meetings
- Ignis Rose Care may make online scheduling and virtual meeting functionality available through the Website from time to time. Such functionality may be provided through third-party platforms, including Calendly, Google Calendar, Google Meet, Zoom or similar services, and may be used to arrange introductory calls, consultations, assessments or other administrative meetings.
- Use of any third-party scheduling or video-conferencing service may also be subject to the applicable provider’s own terms of use, privacy policy and technical requirements. Ignis Rose Care is not responsible for the independent operation, availability or privacy practices of third-party platforms, except to the extent required by applicable law.
- Scheduling an appointment through the Website or a linked third-party platform is administrative only and does not, by itself, constitute acceptance of any individual as an Ignis Rose Care client, create a client-care relationship, establish or approve a plan of care, guarantee the availability of any particular service or caregiver, or constitute a booking for the provision of home-care services. Any provision of home-care services remains subject to Ignis Rose Care’s applicable assessment, intake, availability and contracting requirements.
- Where online scheduling functionality is made available, users should provide at least 24 hours’ notice where reasonably practicable if they need to cancel or reschedule an appointment. Any rescheduled appointment will remain subject to availability. Ignis Rose Care may also cancel or reschedule an appointment where reasonably necessary and will use reasonable efforts to provide advance notice where practicable.
- The availability of online scheduling or video-meeting functionality does not create any obligation on Ignis Rose Care to respond within a particular timeframe or to provide services following the meeting.
- Online appointments, scheduling tools and video-meeting platforms must not be used to seek emergency assistance. Any medical emergency, immediate threat to health or safety, or other urgent situation should be dealt with in accordance with Section 6 of these Terms.
15. Payments
- The Website does not currently process payments for home-care services and is not intended to establish the financial terms on which such services are provided. Any fees, charges, billing arrangements, invoicing procedures, payment due dates, deposits, minimum service requirements, insurance arrangements or other payment obligations relating to the provision of home-care services will be set out in the applicable client service agreement, rate schedule, service plan or other service-specific documentation agreed between Ignis Rose Care and the relevant client or responsible party.
- Any information made available through the Website concerning pricing, payment methods, insurance, benefits or other funding arrangements is provided for general informational purposes only unless expressly stated otherwise. Such information does not constitute a quotation, guarantee of pricing, confirmation of eligibility for coverage or reimbursement, or variation of any payment terms agreed separately with a client.
- Where payment for services may be made through private pay, long-term care insurance, a waiver program, veterans’ benefits or another third-party funding source, the availability of such funding will remain subject to the eligibility criteria, authorization requirements, coverage limits, reimbursement rules and decisions of the relevant insurer, government agency, benefits administrator or other responsible third party. Ignis Rose Care does not guarantee that any particular service will be covered or reimbursed by a third-party payer unless expressly confirmed in writing.
- The client or responsible party remains responsible for satisfying any payment obligations imposed under the applicable service documentation, including any amounts not paid or reimbursed by a third-party funding source, to the extent provided for in that documentation and permitted by applicable law.
- If Ignis Rose Care introduces online payment functionality, payment portals or other Website-based financial features in the future, additional terms, disclosures and third-party payment-provider conditions may apply. Ignis Rose Care may update these Terms or introduce separate payment terms before or after such functionality is made available.
16. Service Cancellations and Changes
- The cancellation, rescheduling, suspension or modification of home-care services is governed by the applicable client service agreement, plan of care, service schedule or other service-specific documentation and not by these Website Terms. Any notice period required for cancelling or rescheduling scheduled care, any applicable cancellation charge, and any other consequence arising from a cancellation or change to agreed services will be determined in accordance with the relevant client documentation. Nothing on the Website should be interpreted as varying or replacing those service-specific requirements.
- Where a client or responsible party wishes to cancel, postpone or change scheduled home-care services, notice should be provided to Ignis Rose Care using the contact method specified in the applicable client documentation. Submission of a general Website contact form does not necessarily constitute valid notice of cancellation where a separate notice procedure has been agreed for existing services.
- Any requested change to scheduled services, including changes to visit times, frequency, duration, caregiver arrangements or commencement dates, will remain subject to staffing, scheduling and operational availability and any applicable requirements under the client's plan of care or service agreement. Ignis Rose Care is not required to accommodate a requested change where it is not reasonably practicable, cannot be provided safely or lawfully, or would be inconsistent with the applicable service arrangements.
- Ignis Rose Care may also need to cancel, suspend, reschedule or modify services where reasonably necessary due to circumstances such as caregiver unavailability, safety concerns, changes in the client's needs, circumstances affecting the suitability or lawful provision of services, emergencies, severe weather, operational disruption or other circumstances addressed in the applicable client documentation. Any such cancellation or modification will be handled in accordance with the relevant service agreement and applicable law.
- For the avoidance of doubt, the cancellation and rescheduling provisions applicable to introductory calls, assessments or other appointments arranged through online scheduling tools are dealt with separately in Section 14. Those provisions do not govern the cancellation of home-care services once a client service relationship has been established.
17. Testimonials and Reviews
- The Website may permit clients, family members, responsible parties or other individuals to submit feedback, testimonials or reviews concerning their experience with Ignis Rose Care. The submission of any testimonial or review does not, by itself, authorize Ignis Rose Care to publish, reproduce, distribute or otherwise use that content on the Website or in other promotional or marketing materials.
- Where Ignis Rose Care wishes to publish an identifiable testimonial, it will obtain an appropriate written Review and Testimonial Release Authorization or other legally sufficient authorization before publication, where required. Acceptance of these Terms, use of the Website or submission of feedback does not replace any separate consent, release or authorization required for publication.
- Where a proposed testimonial contains, refers to or could reasonably reveal health-related information, information concerning care services received, or other information protected by applicable privacy or health-information law, Ignis Rose Care will obtain any additional authorization required by law before publication. Nothing in these Terms is intended to authorize the use or disclosure of protected health information or other protected personal information where separate authorization is legally required.
- Where publication has been properly authorized, Ignis Rose Care may make reasonable editorial changes to a testimonial for purposes of length, spelling, grammar, formatting, clarity or presentation, provided that such changes do not materially alter the substance, meaning or overall impression of the testimonial. Ignis Rose Care will not knowingly edit a testimonial in a manner that creates a materially misleading representation of the individual’s experience.
- Ignis Rose Care may decide whether, where and for how long an authorized testimonial is displayed and may remove a testimonial from the Website at any time. Where the applicable authorization permits the individual to withdraw consent to continued publication, any valid withdrawal request will be handled in accordance with the terms of that authorization and applicable law. Removal following a withdrawal request may require a reasonable period of time to implement across Website content and other materials within Ignis Rose Care’s control.
- Testimonials and reviews reflect the personal experiences, views and opinions of the individuals who provide them. Individual experiences may vary depending on a range of factors, including a client’s circumstances, needs, care arrangements and services received. No testimonial or review constitutes a representation, warranty, promise or guarantee that another client will receive the same services, experience or outcome.
18. Blogs, Videos and Educational Content
- Ignis Rose Care may from time to time publish or make available blogs, articles, videos, podcasts, guides and other educational or informational materials through the Website or through third-party platforms linked from the Website.
- All such content is provided for general educational and informational purposes only. It is not intended to address the individual circumstances, health status, care needs or personal situation of any particular person and should not be relied upon as a substitute for an assessment, plan of care or advice from an appropriately qualified professional.
- The publication or availability of educational content does not create a client-care, caregiver-client, fiduciary, professional or other service relationship between Ignis Rose Care and any person who accesses or relies upon that content. Nor does it constitute a recommendation that any particular service, care arrangement, treatment, product or course of action is suitable for a specific individual.
- Any references to health conditions, care needs, medications, benefits, insurance, legal matters, financial matters or other professional subjects are general in nature only and do not constitute medical, nursing, legal, financial, insurance, tax or other professional advice. Where individualized advice or assessment is required, users should seek assistance from an appropriately qualified professional.
- Ignis Rose Care may update, revise, remove or replace educational content from time to time. While reasonable efforts may be made to ensure that published materials are accurate and useful when prepared, such content may become outdated and should not be relied upon as a definitive statement of current law, regulation, clinical guidance or professional practice.
- Where content is hosted on, embedded from or linked to a third-party platform, use of that platform may also be subject to the applicable third party’s terms, privacy policy and other rules. Ignis Rose Care is not responsible for the independent content, operation or practices of third-party platforms, except to the extent required by applicable law.
19. Third-Party Platforms and Links
- The Website may contain links to, embed content from or otherwise interact with websites, applications and services operated by third parties. These may include scheduling providers, video-meeting platforms, social-media services, video-hosting platforms, mapping services, analytics providers and other technology or service providers used in connection with Website functionality.
- Third-party websites and services are operated independently from Ignis Rose Care and may be subject to their own terms of use, privacy policies, cookie practices, security measures and other conditions. Access to or use of any third-party service is therefore subject to the terms and practices of the relevant provider, and users should review those terms and policies where appropriate.
- The inclusion of a link to, or integration with, a third-party website or service is provided for convenience, functionality or informational purposes and does not, by itself, constitute an endorsement, approval or recommendation by Ignis Rose Care of that third party or of all content, products, services, statements, practices or materials made available through it.
- To the extent permitted by applicable law, Ignis Rose Care is not responsible for the independent operation, availability, accuracy, content, security or privacy practices of third-party websites or services that are outside its control. This includes any interruption, error, loss or other issue arising solely from a third party's systems, content or conduct.
- Where a third-party platform is used to facilitate a function connected with Ignis Rose Care, such as appointment scheduling, virtual meetings, mapping or social-media access, use of that platform does not alter the nature of the underlying relationship with Ignis Rose Care. In particular, use of a third-party scheduling or communications platform does not, by itself, create a client-care relationship, constitute acceptance for services or vary any applicable client service agreement or other documentation.
- Nothing in this Section limits any responsibility that Ignis Rose Care may have under applicable law in relation to its own selection, use or management of third-party service providers or its own handling of personal information through such providers.
20. Accuracy and Availability of Website Information
- Ignis Rose Care uses reasonable efforts to ensure that information made available through the Website is accurate, useful and current at the time it is published. However, Website content may from time to time contain inaccuracies, omissions or outdated information, and Ignis Rose Care does not warrant that all information on the Website will be complete, error-free or continuously up to date.
- Information concerning services, staffing, service areas, scheduling, availability, pricing, eligibility criteria, payment arrangements and other operational matters may change from time to time. The inclusion of any service, feature, rate or other information on the Website does not constitute a guarantee that the relevant service or arrangement will be available to a particular individual, in a particular location or at a particular time.
- Where Website information is material to a decision concerning whether to seek or arrange services, users should obtain current confirmation directly from Ignis Rose Care before relying on that information. Any individualized information subsequently provided by Ignis Rose Care as part of an assessment, intake process, service proposal, plan of care or client service agreement will take precedence over general information appearing on the Website to the extent of any inconsistency.
- Ignis Rose Care may update, correct, amend, remove or replace Website content at any time where reasonably necessary to reflect changes in services, law, regulation, operational requirements or other circumstances. No obligation arises to maintain any particular Website content indefinitely or to provide notice of every non-material change, except where applicable law requires otherwise.
21. Intellectual Property Rights
- Unless otherwise expressly stated, the Website and the content made available through it are owned by, licensed to or otherwise lawfully used by Ignis Rose Care and are protected by applicable copyright, trademark and other intellectual property laws. This includes, without limitation, the Ignis Rose Care name, logos and branding, Website text, photographs, videos, graphics, illustrations, layouts, design elements, educational materials, articles, blogs, downloadable materials and other original content made available through the Website.
- Subject to these Terms, Ignis Rose Care grants users a limited, revocable, non-exclusive and non-transferable right to access and use the Website and its content for lawful personal and informational purposes only. No ownership interest or other intellectual property right is transferred to any user by virtue of access to or use of the Website.
- Except to the extent permitted by applicable law or with the prior written consent of Ignis Rose Care, Website content may not be copied, reproduced, republished, distributed, transmitted, displayed, modified, adapted, translated, commercially exploited or otherwise used in whole or in substantial part for any unauthorized purpose. Users must not remove, obscure or alter any copyright, trademark, proprietary or other rights notice appearing on or in connection with the Website or its content.
- The Ignis Rose Care name, logos, branding and other distinctive identifiers may not be used in any manner that falsely suggests sponsorship, endorsement, affiliation, approval or other association with Ignis Rose Care. Nothing in these Terms grants any license or right to use any Ignis Rose Care trademark, service mark, trade name, logo or other brand feature except as strictly necessary to access and use the Website in accordance with these Terms.
- Users must not systematically scrape, crawl, harvest, extract, index or reproduce Website content for the purpose of creating or contributing to an unauthorized database, directory, commercial service or competing resource, nor may Website content be used in a misleading, deceptive, defamatory or otherwise unlawful manner.
- Where the Website includes materials, trademarks, photographs, videos, software, links or other content owned or supplied by third parties, all rights in those materials remain with the relevant third-party rights holder. The inclusion of third-party content on the Website does not transfer ownership of that content to Ignis Rose Care or to any Website user, and such content may be subject to separate terms, licenses or usage restrictions imposed by the relevant rights holder.
22. Acceptable Use
- The Website may be used only for lawful purposes and in a manner consistent with these Terms. Users must not use, or attempt to use, the Website in any way that is unlawful, fraudulent, deceptive, abusive, harmful to others or inconsistent with the intended purpose of the Website.
- Without limitation, users must not use the Website to impersonate another person, misrepresent their identity, authority, relationship or affiliation, or knowingly provide materially false, inaccurate or misleading information. Users must not submit information about another individual where they know that they lack authority or another lawful basis to provide that information.
- The Website must not be used to harass, threaten, abuse, defame or otherwise unlawfully interfere with the rights or interests of another person. Users must not use the Website in a manner that infringes or misuses any intellectual property, privacy, confidentiality or other legal right of Ignis Rose Care or any third party.
- Users must not introduce, transmit or attempt to introduce malware, viruses, malicious code, harmful software or other technology designed to damage, disrupt, disable, interfere with or gain unauthorized access to the Website or any related system. Users must not circumvent or attempt to circumvent Website security controls, gain unauthorized access to any account, system, database or information, or probe, scan or test the vulnerability of the Website or any associated system without authorization.
- Users must not attempt to obtain, access, collect or disclose information concerning another client, prospective client, applicant, employee or Website user without appropriate authorization. The Website may not be used to scrape, harvest, extract or otherwise collect personal information or other Website data through automated or unauthorized means.
- Users must not misuse any Website functionality, including contact, referral, assessment, recruitment, scheduling, testimonial or other submission features. This includes submitting spam, bulk communications, malicious or irrelevant material, false referrals, fraudulent employment enquiries or other content that is unrelated to the legitimate purpose of the relevant Website function.
- Users must not take any action that could materially compromise the confidentiality, integrity, security, availability or proper operation of the Website, interfere with another person's use of the Website, impose an unreasonable or disproportionate burden on Website infrastructure, or otherwise disrupt the operation of Ignis Rose Care's systems or services.
- Ignis Rose Care may suspend, restrict or block access to the Website where it reasonably believes that a user has breached this Section, created a security or legal risk, interfered with Website operation, misused Website functionality or otherwise acted in a manner inconsistent with these Terms. Where appropriate, Ignis Rose Care may also take other action available under applicable law.
23. Website Availability
- Ignis Rose Care uses reasonable efforts to maintain the availability and proper functioning of the Website. However, continuous, uninterrupted or error-free access to the Website is not guaranteed, and the Website or any part of it may from time to time be unavailable, delayed, restricted or interrupted.
- Website availability may be affected by planned or emergency maintenance, technical faults, software or hosting issues, cybersecurity incidents, Internet or telecommunications failures, third-party service outages, upgrades, system changes or other circumstances beyond the reasonable control of Ignis Rose Care.
- Ignis Rose Care may, where reasonably necessary, modify, update, replace, suspend, restrict or discontinue any part of the Website or any Website feature, including forms, scheduling functionality, third-party integrations, informational content or other services made available through the Website. Such changes may be made to address operational, technical, security, legal, regulatory or business requirements.
- Where reasonably practicable, Ignis Rose Care may seek to minimize disruption to Website users, but it is not required to maintain the availability of any particular Website feature indefinitely. The temporary or permanent unavailability of a Website feature does not, by itself, affect any separate client service agreement or other contractual arrangement entered into with Ignis Rose Care.
- To the fullest extent permitted by applicable law, Ignis Rose Care will not be responsible for losses arising solely from temporary Website unavailability, interruption or delay caused by circumstances outside its reasonable control, subject always to any rights or remedies that cannot lawfully be excluded or limited.
24. Website Disclaimers
- The disclaimers in this Section apply to the Website, its functionality and the general information and materials made available through it. They are intended to govern Website use only and do not replace, amend or limit any obligations that apply to home-care services actually provided by Ignis Rose Care under a separate client service agreement, plan of care or other service-specific arrangement.
- To the fullest extent permitted by applicable law, the Website and its content are made available on an “as is” and “as available” basis. Ignis Rose Care does not warrant or represent that access to the Website will be uninterrupted, continuous, secure or error-free, or that all Website content will at all times be complete, accurate, current or suitable for every user’s individual circumstances.
- Without limiting the foregoing, Ignis Rose Care does not guarantee that every item of information published on the Website will remain current at all times, that every error or omission will be identified or corrected immediately, that all Website functions or third-party links will remain continuously available, or that the Website or any particular feature will meet the specific needs or expectations of every user.
- The Website may include general information concerning Ignis Rose Care’s services, care-related topics, scheduling, referrals, employment opportunities, payment sources or other matters. Such information is provided for general informational purposes only and should not be treated as a guarantee that any particular service, arrangement, opportunity, funding source or outcome will be available to a particular individual.
- Ignis Rose Care does not make any representation or warranty as to the independent content, availability, accuracy, security or operation of third-party websites, platforms or services that may be linked to or integrated with the Website, except to the extent that applicable law imposes responsibility on Ignis Rose Care in relation to its own use of such third-party services.
- Nothing in this Section excludes, limits or disclaims any warranty, duty, obligation, right or remedy that cannot lawfully be excluded or limited under applicable law. To the extent any disclaimer in these Terms is inconsistent with a mandatory statutory right or obligation, the applicable law will prevail to the extent of the inconsistency.
25. Limitation of Liability
- The limitations in this section apply only to liability arising from or in connection with access to, use of, or reliance upon the website and its general content. They are not intended to govern, replace or modify any liability arising from home-care services actually provided by ignis rose care under a separate client service agreement, plan of care or other service-specific arrangement.
- To the fullest extent permitted by applicable law, ignis rose care will not be liable for any loss, damage, cost or expense arising solely from a user’s reliance on general website information where individualized professional advice, assessment or confirmation was reasonably required, or from reliance on information that had become outdated where current information could reasonably have been confirmed directly with ignis rose care.
- Ignis rose care will also not be liable, to the fullest extent permitted by law, for losses arising solely from temporary website unavailability, interruption, delay, technical failure or loss of access, including where caused by internet, telecommunications, hosting, software or third-party platform failures outside ignis rose care’s reasonable control. The same applies to loss arising solely from the independent content, conduct or failure of a third-party website or service linked to or integrated with the website, except to the extent that applicable law imposes responsibility on ignis rose care for its own acts or omissions in relation to that third party.
- To the fullest extent permitted by applicable law, ignis rose care will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising solely from access to, inability to access, use of or reliance upon the website, including any loss of opportunity, loss of data or other consequential economic loss, except where such liability cannot lawfully be excluded or limited.
- Nothing in these terms limits or excludes liability arising from the actual provision of home-care services where such liability is governed by an applicable client service agreement, plan of care, statutory or regulatory duty, professional obligation or other applicable law. in particular, the website-specific limitations in this section do not alter any duty or standard applicable to ignis rose care in connection with services actually provided to a client.
- Nothing in these terms excludes, restricts or limits any liability, duty, right or remedy to the extent that exclusion or limitation is prohibited by applicable law. this includes any rights or remedies that must remain available under applicable consumer-protection, privacy, health-information, healthcare, home-care or other mandatory law.
- The limitations in this section are intended to apply only to the maximum extent permitted by applicable law and will be interpreted accordingly.
26. Indemnification
- To the fullest extent permitted by applicable law, a user agrees to indemnify, defend and hold harmless Ignis Rose Care and its officers, employees, agents and representatives from and against third-party claims, liabilities, losses, damages, judgments, penalties and reasonable costs and expenses, including reasonable attorneys’ fees, to the extent directly arising from that user’s: a. intentional or unlawful misuse of the Website; b. unauthorized access to, interference with or disruption of the Website or related systems; c. knowing submission of materially false, fraudulent or misleading information; d. knowing infringement or misappropriation of another person’s intellectual property, privacy, confidentiality or other legal rights; e. submission or disclosure of another person’s personal information where the user knowingly lacked authority or another lawful basis to provide that information; f. introduction of malware, malicious code or other harmful technology into the Website or related systems; or g. material breach of the acceptable-use obligations set out in these Terms where that breach gives rise to a third-party claim against Ignis Rose Care.
- The indemnity in this Section applies only to the extent that the relevant claim, loss or liability is caused by the user’s conduct described above. It does not require a user to indemnify Ignis Rose Care for losses resulting from Ignis Rose Care’s own negligence, willful misconduct, violation of law, breach of these Terms or breach of any independent duty owed by Ignis Rose Care. Ignis Rose Care will provide reasonable notice of any material third-party claim for which indemnification is sought, where practicable. Ignis Rose Care may participate in the defense or settlement of the claim and may assume control of the defense where reasonably necessary to protect its interests. No settlement that imposes a material admission of liability or non-monetary obligation on a user may be agreed on that user’s behalf without that user’s consent, such consent not to be unreasonably withheld where applicable. Nothing in this Section limits any right or remedy available to a user under applicable law or transfers to the user any legal or regulatory obligation that is independently imposed upon Ignis Rose Care.
27. User Responsibility for Certain Misuse
- To the fullest extent permitted by applicable law, a user will be responsible for losses, costs or liabilities reasonably incurred by Ignis Rose Care to the extent directly resulting from that user’s intentional, knowing or unlawful misuse of the Website. This includes, without limitation, losses arising from unauthorized access to or interference with Website systems; the deliberate introduction of malware, malicious code or other harmful technology; the knowing infringement of third-party intellectual property rights; the knowing misuse, unauthorized disclosure or improper submission of another person’s personal or confidential information; or a knowingly false representation that the user is authorized to act for, refer or provide information concerning another person.
- A user will also be responsible for losses directly resulting from any other intentional and unlawful use of the Website that materially compromises its security, availability or integrity, interferes with the rights of another person, or exposes Ignis Rose Care to a third-party claim or regulatory action.
- Any responsibility imposed under this Section is limited to losses that are reasonably attributable to the relevant user’s conduct. Nothing in these Terms requires a user to bear responsibility for any loss caused by Ignis Rose Care’s own negligence, willful misconduct, unlawful conduct, breach of these Terms or breach of any legal or regulatory obligation that applies independently to Ignis Rose Care.
- This Section is intended to supplement, and not duplicate or expand beyond, the indemnification provisions set out elsewhere in these Terms. Where the same conduct gives rise to a claim under both provisions, Ignis Rose Care will not be entitled to recover the same loss more than once..
28. Accessibility
- Ignis Rose Care is committed to providing reasonable access to the information and functionality made available through the Website and may take appropriate steps from time to time to improve the accessibility and usability of Website content. If a user experiences difficulty accessing particular Website content, completing a Website function or obtaining information through the Website, the user may contact Ignis Rose Care using the contact details set out in these Terms. Where reasonably practicable, Ignis Rose Care may provide the relevant information or assistance through an alternative format or communication method.
29. Suspension or Restriction of Access
- Ignis Rose Care may suspend, restrict, disable or block access to some or all of the Website where reasonably necessary to protect the security, integrity, availability or lawful operation of the Website or related systems.
- Such action may be taken, without limitation, where Ignis Rose Care reasonably considers it necessary to investigate suspected misuse, prevent fraudulent or unlawful activity, address a cybersecurity or technical issue, respond to unauthorized access or attempted access, comply with a legal or regulatory requirement, protect confidential or personal information, or safeguard Ignis Rose Care, its clients, prospective clients, employees, applicants, service providers or other Website users.
- Where the circumstances permit, any restriction will be proportionate to the relevant risk or issue. Ignis Rose Care may restore access once the reason for the restriction has been resolved or no longer applies. Suspension or restriction of Website access does not, by itself, terminate or vary any separate client service agreement or other contractual relationship with Ignis Rose Care, unless otherwise provided in the applicable agreement or required by law.
30. Changes to the Website
- Ignis Rose Care may update, amend, replace, suspend or discontinue Website content, functionality, forms, integrations, features or other elements from time to time to reflect changes in its services, operations, technology, legal or regulatory requirements, security needs or business practices. This may include changes to service descriptions, referral or assessment functionality, employment enquiry processes, scheduling tools, educational content, third-party integrations and other administrative features.
- The availability of any particular Website feature or item of content at a given time does not constitute a commitment that the feature or content will remain available indefinitely. Ignis Rose Care may remove or modify Website functionality without prior notice where reasonably necessary, subject to any notice requirement imposed by applicable law. Changes to the Website do not, by themselves, amend any existing client service agreement, plan of care or other separately executed agreement.
31. Changes to These Terms
- Ignis Rose Care may revise these Terms from time to time to reflect changes to the Website, its business practices, applicable law or regulation, security requirements, operational processes or other reasonable business needs.
- The version of the Terms then in effect will be made available through the Website and will identify the applicable effective date or last-updated date. Unless applicable law requires otherwise, amendments will apply prospectively from the date on which the revised Terms become effective.
- Where applicable law requires specific notice of a material amendment, or requires affirmative consent or acceptance before a change may take effect, Ignis Rose Care will provide such notice or obtain such consent in the manner required by law.
- Continued use of the Website after revised Terms become effective may constitute acceptance of those revisions to the extent permitted by applicable law. Where affirmative acceptance is legally required, continued use alone will not be treated as a substitute for that acceptance.
- No amendment to these Website Terms will, merely by being posted on the Website, modify an existing client service agreement, approved plan of care, payment arrangement, employment agreement, authorization, consent or other separately executed document unless that document expressly provides otherwise.
32. Separate Consents And Authorizations
- Acceptance of these Terms governs general use of the Website only. It does not, by itself, constitute any consent, authorization, acknowledgement or agreement that applicable law, Ignis Rose Care or a separate service relationship requires to be obtained independently. In particular, acceptance of these Terms does not constitute acceptance of any individual as an Ignis Rose Care client, agreement to or approval of a plan of care, authorization for the use or disclosure of health information where separate authorization is required, a HIPAA authorization where applicable, authorization to publish a testimonial or review, consent to receive promotional or marketing communications where separate consent is required, or consent to collect, share, sell or otherwise process consumer health data where applicable law requires a separate affirmative consent or authorization.
- Acceptance of these Terms also does not constitute consent to an employment background check, authorize the collection of information required for recruitment or onboarding, or replace any client service agreement, privacy notice, release, disclosure, authorization, acknowledgement or other document that must be provided, accepted or signed separately. Where a separate consent or authorization is required, Ignis Rose Care will obtain or present that consent or authorization through its approved internal process and in the manner required by applicable law.
33. No Offer or Guarantee of Care Services
- Descriptions of services, care options, availability, scheduling information and other materials appearing on the Website are provided for general informational purposes and to explain the types of home-care services that Ignis Rose Care may be able to provide. Nothing appearing on the Website constitutes a binding offer by Ignis Rose Care to provide home-care services to any individual. No agreement for the provision of services is created merely by accessing or using the Website, submitting an enquiry or referral, requesting an assessment, identifying a preferred start date or care schedule, scheduling an introductory appointment, or otherwise communicating with Ignis Rose Care through the Website.
- Any indication of availability, proposed timing, service description or other information provided through the Website remains subject to further assessment and confirmation by Ignis Rose Care. The availability and suitability of services may depend on the prospective client’s assessed needs, location, staffing and scheduling capacity, applicable licensing and regulatory requirements, safety considerations, payment arrangements and other matters relevant to the provision of care.
- A binding agreement for home-care services will arise only when Ignis Rose Care has completed its applicable assessment and intake requirements, agreed the relevant service arrangements and the required client service documentation has been entered into or otherwise completed in accordance with Ignis Rose Care’s procedures. Nothing in this Section affects any rights or obligations arising under a client service agreement once such an agreement has been entered into.
34. Governing Law And Jurisdiction
- These Terms, their interpretation and any dispute, claim or controversy arising out of or relating to the Website, these Terms or their subject matter will be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any choice-of-law or conflict-of-laws rule that would require the application of the laws of another jurisdiction. Nothing in these Terms is intended to exclude, restrict or waive any mandatory right, protection or remedy available to a consumer or other Website user under applicable law where such right, protection or remedy cannot lawfully be waived by agreement.
- Subject to any mandatory right to bring proceedings in another jurisdiction or forum, any action, proceeding or dispute arising out of or relating to these Terms or use of the Website may be brought before a court of competent jurisdiction in the State of Washington. Any dispute arising from the actual provision of home-care services may additionally be subject to the dispute-resolution, governing-law or jurisdiction provisions contained in the applicable client service agreement or other service-specific documentation.
35. Contact Information
- Questions concerning these Terms, the operation of the Website or general Website use may be directed to:
- Ignis rose Care LLC
- Website: www.ignisrosecarellc.com
- Email: support@ignisrosecarellc.com
- Telephone: 425-491-3939
- Requests relating to privacy, personal information, health information or consumer health data should be submitted using the contact details and procedures specified in the applicable Ignis Rose Care Privacy Policy or any other privacy notice applicable to the relevant information.
- Contacting Ignis Rose Care through the details above does not create a client-care relationship or constitute acceptance of any person for services except where expressly confirmed through the applicable intake and contracting process.
36. Severability
- If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful or unenforceable, that provision will, to the extent legally permissible, be interpreted or modified to the minimum extent necessary to make it valid and enforceable while preserving its intended effect as closely as possible. Where such modification is not legally permissible, the affected provision will be severed from these Terms. The invalidity or unenforceability of that provision will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.
37. No Waiver
- No failure or delay by Ignis Rose Care in exercising any right, power or remedy available under these Terms or applicable law will constitute a waiver of that right, power or remedy. Any waiver must be express and applies only to the particular circumstances for which it is given. A waiver of one breach or matter will not constitute a waiver of any subsequent breach or of any other provision of these Terms. No course of conduct between Ignis Rose Care and a Website user will operate as a waiver or modification of these Terms unless expressly agreed in writing where such agreement is required.
38. Entire Agreement as to Website Use
- These Terms, together with any policies, notices or additional Website terms expressly incorporated into them, constitute the agreement between Ignis Rose Care and the user concerning general access to and use of the Website. These Terms apply only to the Website and do not replace, amend or supersede any separate agreement, authorization, consent or other documentation governing a distinct relationship with Ignis Rose Care. This includes, without limitation, any client service agreement, plan of care, payment or rate agreement, privacy or health-information authorization, employment agreement, testimonial or media release, referral agreement or other separately executed document. Where a separate agreement governs a particular service or relationship and contains terms that are inconsistent with these Website Terms, the separate agreement will control in relation to that service or relationship, while these Terms will continue to govern general use of the Website.
39. Assignment
- Users may not assign, transfer or otherwise dispose of any rights or obligations arising under these Terms without the prior written consent of Ignis Rose Care. Ignis Rose Care may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, sale or transfer of all or a material part of its business or assets, or another lawful corporate transaction, subject to applicable law. Any transfer involving personal information will remain subject to applicable privacy and health-information requirements.
40. Relationship of the Parties
- Nothing in these Terms creates or is intended to create any partnership, joint venture, agency, employment, fiduciary or similar relationship between Ignis Rose Care and a Website user solely by reason of the user’s access to or use of the Website. Except where expressly authorized in writing, no Website user has authority to bind Ignis Rose Care, make representations on its behalf or incur obligations in its name. For the avoidance of doubt, the establishment of a client-care relationship is governed separately in accordance with the applicable assessment, intake and client contracting process.
41. No Third-party Beneficiaries
- Except where expressly provided otherwise, these Terms are intended solely for the benefit of Ignis Rose Care and the individual user to whom they apply. No other person or entity acquires any right to enforce any provision of these Terms merely because that person or entity may benefit indirectly from their performance. This Section does not limit any right or remedy conferred directly on a third party by applicable law.
42. SURVIVAL
- Any provision of these Terms which by its nature is intended to continue after a user ceases using the Website will survive termination or cessation of Website use. Without limitation, provisions concerning intellectual property, user responsibility, indemnification, limitations of liability, governing law, jurisdiction, severability and any accrued rights or liabilities will continue to apply to the extent necessary to give them effect.
43. Events Beyond Reasonable Control
- Ignis Rose Care will not be responsible for a failure or delay in operating or maintaining the Website to the extent caused by circumstances beyond its reasonable control, including failures of Internet or telecommunications infrastructure, hosting-provider outages, cyberattacks, acts of government, natural disasters, severe weather, public emergencies, labor disruptions or other comparable events. This Section applies only to Website operation and does not alter any separate obligations relating to the provision of home-care services under an applicable client service agreement or mandatory law.
44. Interpretation
- Headings and section titles are included for convenience and readability only and do not affect the interpretation of these Terms. Words such as “including,” “includes” and “in particular” are illustrative and do not limit the general meaning of the words that precede them. References to laws or regulations include those laws or regulations as amended, replaced or re-enacted from time to time, together with applicable implementing rules, to the extent relevant. References to the “Website” include the webpages, forms, features and functionality made available through www.ignisrosecarellc.com, unless the context requires otherwise.
